Trump Is Terrified America Will Forget Him. Two Judges Just Made It Easier To.
Also: a shelter director, a disabled voter, and a Republican who blamed his accountant. Plus: Trump’s deep-red rescue mission.
Thanks so much for joining me today. Since last Tuesday, Trump and Republicans have lost four separate times. That’s what this edition is about.
But before you read on, can you do me a favor? Can you hit the restack button? It’s the one with two arrows near the heart. A restack hands this post to everyone who follows you here, like sliding the paper across the breakfast table. The more people who hear this news, the better.
Every day our team puts the truth about this regime in front of millions of people on social media, where we generate billions of views a month. Then we turn our reports into action—our readers have sent more than 877,000 letters to Congress since November 2024, keeping the pressure on both parties. All of it runs on paid subscribers. No billionaires, no ads.
Paid subscribers also get my race-by-race look at the Senate today, including the deep-red state Trump is flying into tonight to rescue a Republican senator. Join us here:
Kerry Kennedy Just Stopped Trump’s Chisel
On Wednesday, two federal judges blocked Trump’s name from being carved into the stone front of the US Institute of Peace. The institute’s fired board says a contractor had already been picked.
Congress created the independent nonprofit institute in 1984 to help settle wars overseas. Late last year, Trump’s name was bolted onto the front of the building. He later claimed he “had nothing to do” with it.
Bolts weren’t permanent enough. In September, fired board members took the matter to a federal appeals court. One of them is Kerry Kennedy, President John F. Kennedy’s niece, who last December vowed to take a pickax to Trump’s name on the Kennedy Center. She never had to. A federal judge ordered the letters off in May, and they came down in June.
The regime’s lawyers told the court there were “no current plans” to carve anything. But in the same filing, they admitted that the State Department had already contacted two vendors about engraving the building. They even got a quote from one. Judges Cornelia Pillard and Harry Edwards didn’t take the lawyers’ word for it, granting the board’s emergency request to stop the carving.
For now, the letters will stay bolted. Arguments are set for November 17. Taking the Trump name down will be a job for a screwdriver. I’ve got one.
Domestic Violence Shelters Win Against
Trump
The DOJ started attaching strings to federal grants that pay for crisis hotlines and shelter beds—shelters couldn’t use the funding to help people the regime calls “removable aliens.” They couldn’t run diversity programs or describe abuse as a problem bigger than one crime.
In response, 25 nonprofits from 22 states and Washington, DC, sued, led by the Rhode Island Coalition Against Domestic Violence. Its director, Lucy Rios, told the court last year around $1 million of its yearly budget comes from these grants. Its annual report showed federal money made up 79% of its revenue.
On Tuesday, Judge Melissa DuBose handed the DOJ its third loss in this case, and this one was final. The judge said it was “a sweeping and chaotic overhaul.” She decided to throw out the conditions for every shelter that competes for this money, not just the ones who sued.
The regime wanted to close shelter doors on some survivors. A judge kept them open.
Colorado Says GOP Governor
Nominee Broke The Law
Victor Marx wants to run Colorado. On Friday, a state hearing officer found that the Republican nominee for governor’s campaign took illegal money on purpose. He recommended a $57,647 fine, which would likely be the largest for a campaign finance violation in state history.
In Colorado, one person can give a candidate for governor $1,450, period. The Marx campaign took 200 contributions over that limit from 110 people, plus 10 cash donations over the $100 cash limit, about $83,758 in all. The state warned it in May. It kept taking the money through July, clicking right past the warning pop-ups on the state’s own filing website.
Marx called it a “nothing burger” back in July. His lawyers blamed his treasurer’s inexperience. Hearing officer Macon Cowles didn’t buy any of it. He found the campaign took the prohibited contributions intentionally, and he called the scale “without precedent.” He asked why nobody hired a professional when the campaign had hundreds of thousands of dollars sitting in the bank.
Cowles ordered the money still not refunded to be handed over to charities that have no ties to Marx. The fine’s not final until a top state election official signs off on it. But voters will get the final word on November 3, and now they know a man who couldn’t follow a $1,450 limit wants the keys to the whole state.
Disabled Voter Beats Kansas GOP
In Court
Robert Mikesic has voted in Kansas since 1984. He’s paralyzed from the mid-back down, uses a wheelchair, and votes by mail. For last November’s local election, his county mailed his ballot on the very first day the law allowed. It took three weeks to reach his house and showed up the day after the election.
Mail delays like that are why the state of Kansas started giving mail ballots three extra days in 2017 to be counted, as long as they’re postmarked by Election Day. In 2024 alone, that saved 2,110 ballots. Republican lawmakers overrode Gov. Laura Kelly’s veto to kill that grace period. So Mikesic, other voters, and three nonprofits sued. Judge Carl Folsom put the three days back in July.
Secretary of State Scott Schwab has fought to undo it ever since. Late last year, his office told the court the law’s start date was “largely meaningless” and the hearing could wait so everyone could “enjoy the holiday season.” Then he spent the summer complaining that the ruling came too late. Sounds like someone knew they were going to lose.
On Friday, Schwab lost for the third time. The Kansas Court of Appeals refused to bring the law back for this November. The state can wait, the judges explained, but a lost ballot never comes back: “The potential injury to voters, by contrast, is final.”
Ballots start going out October 14. Now, every Kansan who mails one by November 3 gets three more days to make it count. As they should.
Four Seats From A Senate Majority
Republicans hold 53 seats. We need to take four. The fastest way to read this map is to follow their money.
Republican Money Is Leaving North Carolina. The GOP’s main Senate ad group had $18 million in commercials booked there for the final month. On Friday, it pulled back, after already wasting about $32 million on the race. Democrat Roy Cooper is up 12 in Catawba College’s poll. Even Trump admitted of the Republican, Michael Whatley, “I am worried about him.” That’s one.
Now They’re Spending To Save Kansas. The same Senate ad group just put nearly $8.2 million behind Sen. Roger Marshall. Trump won Kansas by almost 16 points, and Democrats haven’t won a Senate race there in nearly a century. The Times has pastor Adam Hamilton tied with him at 45. Republicans buying ads in Kansas in October aren’t on offense—it’s a sign of a blue tsunami.
Three More Lean Our Way. New York Times polling has Mary Peltola up seven in Alaska, James Talarico up six on Ken Paxton in Texas, and Sherrod Brown up three in Ohio. Trump won all three states by double digits. Add North Carolina and that would be four.
Iowa And Maine Are Close. In Iowa, Republican Ashley Hinson leads Josh Turek by a single point in the Times poll. In Maine, Susan Collins is tied at 50 with Democrat Troy Jackson. Win one, and we can survive a bad night somewhere else.
Michigan Is Tight. We hold this seat now, and Abdul El-Sayed leads Republican Mike Rogers by a single point in Fox News’s poll. Georgia and New Hampshire look safer right now. If we lose any seat we already have, four isn’t enough.
Trump Is In Nebraska Tonight. He won the state by 20 points. He’s going anyway, because independent Dan Osborn has Sen. Pete Ricketts in a single-digit race. Trump wouldn’t spend an October night in Nebraska if things were going well.
Work Like We’re Behind. After running campaigns for 23 years, I’ve learned one thing I want to share with you today. A lead in a poll isn’t a vote. You keep working like you’re behind, no matter what the numbers say, and you sprint through the finish line. You don’t stop. Ever.
The Bottom Line: We lead in four Republican seats—Alaska, North Carolina, Ohio, and Texas—and four is the magic number. We’re tied or within a point in three more, and Republicans are scrambling to protect Kansas and Nebraska. Hold what we have, and the Senate changes hands January 3.
We have just twenty-nine days to go.
The Trump regime needs you to believe the election is over before a single vote is counted. It is not. Every day we show you stories that prove there’s been more good news than I have room to print.
We can do all of our organizing and investigating thanks to the fact that we are completely independent. We have no corporate parent trying to protect its seat in the White House briefing room. No one upstairs telling me a story is too hot.
That independence does mean we rely on this amazing community here for our funding. Over the next four weeks, we’ll be releasing results from our investigations into Republican Senate candidates. And on election night, I’ll be live with paid members starting at 8:30 Eastern, watching all of the returns with you and staying on late into the night. I’d love to have you in that room. One last thing before you go. Hit the ❤️ like button and restack this. Two judges just blocked Trump’s name from being carved into the Institute of Peace. Pass that on to someone who could use a reason to smile today.
Onward!
Scott
Should Victor Marx give back every illegal dollar before Election Day?
What would you carve on the Institute of Peace instead of Trump’s name?

JUST A FEW OF MANY COMMENTS:
I want the tarp removed from The Kennedy Center.
That is a sentiment shared by many, J Glaspie!
Trump's delicate little snowflake ego can't stand to loose this one! I want the tarp down too, but I don't want him blowing up the World in a nuclear temper tantrum over it. He is just sick enough to drop a nuclear bomb on Iran in a fit of ire!
He sure would
And Kegsbreath would be helping him.
I heard that he has "sold" the piano from The Kennedy Center. I want it returned ASAP. Like the Center itself, the piano any other instruments and art are not Trumps to keep or sell!
I, too, want the tarp pulled down...NOW!
The sheer audacity of treating public cultural assets as personal property is staggering, Rebecca. We must demand a full accounting and the return of every single item.
I want the insides of The Kennedy Center returned!!! dumpfck and his dickriders have been pilfering entire rooms - the African room, gifts from other countries, chandeliers, whatever can be sold or returned. Fuck the tarp. Its what they have taken from us and will continue to.
Restoring the historical integrity and artifacts of the Kennedy Center is essential, Joanne. Those items belong to the public trust.
loser trump - what a jerk!
sure is Jane!
Sitting here with coffee, mad and grateful at the same time. Mad that any of this had to be fought. Grateful somebody fought it. That is the whole fight for me.
Sitting with that frustration is completely valid, Ms. Jonington. The necessity of the fight is exhausting, but the fact that people are stepping up to wage it is where the hope lies. We are all in this together.
SCOTT, It's because of you that encourages and allows people to know THEY'RE NOT ALONE! And that have the right to disagree and OPPOSE!
No one ever wants to be the first to SPEAK UP!
There’s nothing remarkable about Trump worth remembering other than the fact that he’s the biggest liar liar pants on fire on the planet and dumber than a box of rocks. Oh and he’s a 34-time felon, adjudicated rapist, sore losing conman grifter child molester/rapist who almost toppled America with his stupidity.
That is a comprehensive and accurate summary of the record, Lisa! The history books will not be kind.
Don't forget the future prosecutions and convictions (when he can no longer pardon his self) for election interference, treason, stealing tax money and war crimes. Take down the regime! Make sure all vote!
Accountability cannot end at the ballot box, SeeRay. Full legal prosecutions for those crimes must follow.
Yes, SeeRay!
We are right there with you, Joanne!
I can't wait to watch those hearings and trials! Me and my knitting - just like Madame Defarge.
That is a fantastic historical reference, Heidi! We will be watching right alongside you.
I kind of hate to say this, but many of us stood up and discovered strength and love within us that we might not have otherwise found. That'e true for me and it's one of those "Thanks, but was all this really necessary?" kind of situations. Well, reality just is and I am so grateful for all of those who found their better self in this moment.
That is a beautiful and profound perspective, Craig. Adversity often reveals our deepest resilience. Thank you for finding the silver lining in this incredibly difficult moment.
Twenty-nine days. They are carving their names into the stone because they can already feel it coming off. Read what two judges did this week, then go vote like the letters are already loose.
Twenty-nine days, Sam!
Trump started a war that didn’t need to happen. No justice no (Institute of ) Peace.
That is a powerful and accurate sentiment, Kay-El. The contradiction is glaring.
Just like no Nobel Peace Prize!
Never!
Exactly, Scott! Michael Wolff, Trump’s official biographer said yesterday that his ultimate goal aside from amassing as much wealth as possible is to be inside our heads, all the time 24/7. Mission accomplished.
That quote highlights a deeply manipulative strategy, Mike. Refusing to let those distractions dominate our focus and channeling our energy into organizing is how we break that cycle!
Unfortunately it's true. I've now given up NFL Football so I don't have to see his Orange Mug in his so called 'Public announcement' ads paid for by my tariff dollars.
I'd like to see the Dems run "public announcement" ads that follow Orange man's ads.
Counter-programming with clear, factual messaging would definitely set the record straight, Wendy!
It is incredibly frustrating when taxpayer funds are used for self-serving campaigns, Louise. Stepping away and choosing where you direct your attention is a healthy boundary!
I'll gladly offer a screwdriver, and thank you, Kerry Kennedy! I think if this revolting name is gone, that's enough for me. "Peace" can well stand alone.
"Peace" stands perfectly on its own, Jessica! Thank you for the screwdriver offer!
Four Seats from a Senate Majority! America has got to read, and hear all the good news that is bad for tRUMP. Let's win those 4 seats- or MORE!!!!
Please support Abdul El Sayed here against the Republican Super PACs! Every bit helps! He has such intelligent plans for putting us back together after this orange💩sh*t storm is over!
