On July 10, 40 organizations wrote to Senate Majority Leader Chuck Schumer outlining three key pillars of insulin pricing and access policies that should be included in the anticipated prescription drug reform package.

Dear Leader Schumer,

Our organizations are committed to advancing access to affordable medicines for patients in the United States, including people with insurance from public programs like Medicare and Medicaid, people with private insurance, and people without insurance coverage.

We are grateful for your commitment to advance insulin legislation through the Senate in this session.[1] To deliver the relief that insulin-dependent patients need and put an end to insulin profiteering, the legislation advanced out of the Senate must include three key elements, described in further detail below:

  • Ensure people with private insurance and those without insurance, who are most vulnerable to rationing, have access to the insulin they need.
  • Stop insulin manufacturers from charging excessive prices.
  • Prevent anticompetitive tactics from drug corporations and middlemen from interfering with patient access to lower-priced insulin products, including biosimilars.

Under your leadership, the 117th Congress passed laws signed by President Biden that made generational advances in lowering drug prices and expanding access to lifesaving treatments like insulin, all while confronting the worst pandemic in a century.

Through the Inflation Reduction Act (IRA), Americans with Medicare Part D will have guaranteed access to insulin for no more than $35 per month out of pocket. Reforms included in the American Rescue Plan lifted the Medicaid rebate limit to allow for deeper penalties on drug corporations that routinely spike prices at rates outpacing inflation, commensurate with the level of the abuse. Medicare may include some insulin products in direct government price negotiations for Part D and impose additional rebates for price increases above the rate of inflation, both also through reforms included in the IRA.

These laws are beginning to show results. Earlier this year, all three of the Big 3 insulin manufacturer corporations announced price concessions that, if fully carried out, will provide significant relief to people who depend on insulin to live. David Ricks, the Chair and CEO of Eli Lilly and Company promised to Sen. Sanders at a Senate HELP Committee hearing that the company would “leave our prices as they are for the insulins on the market today.”[2]

While the reforms advanced by the 117th Congress and concessions by insulin manufacturers can support insulin access for some patients with diabetes, they do not go far enough. A recent study published in the Annals of Internal Medicine found that 1.3 million people in the United States ration insulin.[3] Another recent survey showed as many as 1 in 4 people with type 1 diabetes ration insulin.[4] People without insurance were most likely to ration insulin (29.2% ration insulin), followed by those with private insurance (18.8%).[5] Rationing is disproportionately high for Black Americans, of whom 23.2% ration insulin, compared with 16% of Hispanic and White Americans.[6] Hopefully soon, some of these patients will feel improvements in access and pricing due the policies that have been enacted, but many require further relief – the Senate’s work is far from complete.

Ensuring access

Alec Smith was 26 years old when he aged out of his parents’ health insurance.[7] He made just enough not to qualify for insurance subsidy or patient assistance programs, meaning, like many people without insurance, he was forced to face the full price for his insulin out of pocket. As a result, Alec rationed his insulin supply to wait to afford more, but within days, he died of ketoacidosis.

Any insulin legislation that would not have prevented this tragedy fails the Alec Smith test. It is vital that affordable insulin access is provided to everyone, including those who do not have insurance, in addition to those who are privately insured.

Lowering Prices

Since the 1990’s, insulin manufacturers have raised prices many times over for U.S. patients, as much as 1100%, despite their products remaining largely unchanged, and low production costs.[8]

While the Big Three insulin manufacturers, Eli Lilly, Novo Nordisk, and Sanofi, have committed to lowering the list prices of some of their insulins, these commitments do not apply to all insulins and prices can be raised again at any time. Additionally, to date few patients have been able to access the lower priced insulins promised.

Abusive pricing of insulin, which the very same corporations who sell insulin here sell for a fraction of the price in other wealthy countries,[9] has led to immense profits for these corporations at the cost of preventable suffering and death of people who need insulin, in addition to billions of dollars drained from government coffers and consumers’ bank accounts.

Any insulin legislation that fails to lower the list prices charged by insulin manufacturers would fail to hold these corporations accountable, in effect rewarding them for decades of price gouging.

Preventing Anti-Competitive Gaming

As pharmacy benefit managers (PBMs) demonstrated preferences for covering insulin products with higher list prices to secure larger rebates, insulin manufacturers responded by raising prices in lockstep.[10] Patients who pay out of pocket for all or a portion of list prices that have been sharply increased by drug corporations suffer under this scheme. In some cases, PBMs have continued to place branded biologics with higher list prices on preferred formulary tiers, essentially excluding lower-priced biosimilars and reducing potential savings for patients.[11]

Insulin legislation advanced through the Senate should put an end to perverse arrangements between drug corporations and middlemen that stifle potential savings from lower-priced insulins and put patients’ lives at risk.

Comprehensive insulin legislation must also target anti-competitive tactics drug corporations employ to unduly extend patent monopolies and delay biosimilar competition, including pay-for delay agreements, product hopping, and citizen petition abuses.[12]

President Biden presided over the best midterm elections for the party in the White House in 20 years — despite Washington insiders predicting that Democrats would be wiped out.

Donald Trump did his party no favors with his preening and support for downright awful candidates who lost. Nevertheless, this electoral success belongs to Mr. Biden, who ignored ivory-tower economists and out-of-touch pundits claiming that bold action to help families was bad politics. Instead, Mr. Biden delivered significant economic progress for working people.

Voters rewarded Democrats for protecting the lives and livelihoods of struggling families in a pandemic; modernizing infrastructure, not just talking about it; allowing Medicare to negotiate lower drug prices; capping insulin costs for older Americans; making tax-dodging corporations pay up on billions in profit; lowering carbon emissions and reducing utility bills; and canceling student debt for over 40 million Americans.

Despite global inflation, progressive policies helped Americans counter high costs and created well-paying jobs. Unemployment is at an astonishing 3.7 percent, and the economy is growing. Unlike in recent Democratic administrations, the scope and aggressiveness of Mr. Biden’s policies were not arbitrarily limited by a desire to demonstrate “independence” from progressive Democrats or to play nice with giant corporations. And name-calling from Fox News commentators and financial news analysts did not shake this Democratic administration’s resolve to help working families.

For each of the president’s decisions, the punditry was relentless, but the American people — Democrats, independents and Republicans — validated the president’s agenda with their votes. Passing the American Rescue Plan coincided with the president’s highest approval ratings. The national media heralded passage of the Inflation Reduction Act as the best stretch of the Biden presidency and his approval ratings jumped. The president’s leadership on issues from student debt relief to long-awaited climate action helped motivate young people to vote in near record numbers.

Democrats delivered a lot, but we can do more to make Americans’ lives better. A few lobbyist-friendly Democrats in our own party blocked much of the president’s agenda for working families. They torpedoed the president’s plan to reverse the Trump tax giveaways. They blocked proposals to cut skyrocketing housing and child care costs. They thwarted efforts to fight corruption, end gerrymandering, defend democracy and protect abortion rights. If these Democrats had listened to voters instead of special interests, we would be in an even stronger electoral position today because we would have delivered even more for Americans.

Americans understand that the economic well-being of families is inextricably linked to democracy and to individual rights, even if too many cable news gurus do not. A majority of Americans know that abortion is a kitchen-table issue that is central to both health and economic security, not a distraction. Americans understand that prices are rising in part because of corporate greed, and want a government on their side. Tuesday’s results confirmed those views: across America, every ballot initiative to protect abortion rights passed, along with many proposals to tax the wealthy and put money in workers’ pockets.

The so-called experts who called Democrats’ messaging incoherent were just plain wrong — and candidates who ignored their advice won. John Fetterman embraced populist economic policies and called out corporate greed, and won. Raphael Warnock took a central role in urging the president to cancel student debt, and is strongly positioned to win in Georgia. Many Democratic candidates leaned hard into protecting abortion rights and democracy while also aggressively supporting popular economic plans.

The president’s critics remain unchastened by the election results. Lobbyists are already calling for Democrats to pass unpopular policies and to help their wealthy clients avoid taxes. Some in Washington are back to insisting that “responsible government” requires responding to voters’ rejection of Republican extremism by holding hands with the extremists. Nonsense.

If Republicans take the House, their majority will be stacked with election deniers who have embraced one overriding goal: the restoration of Donald Trump as president in 2024. They believe economic chaos weakens President Biden, so they are itching to use their leverage to hurt working families. This is the same strategy Republicans used after the 2010 midterms when they set off a debt-ceiling crisis, then demanded family-crushing austerity.

Democrats should fight back by making this lame-duck session of Congress the most productive in decades. We can start by lifting the debt ceiling now to block Republicans from taking our economy hostage next year. Democrats must then continue delivering for families. Where we can pursue legislative action, we should fight aggressively. When Republicans try to obstruct such action and the president can act by executive authority, he must. Most of all, the Democrats should be aggressive in putting Republicans on the defensive, pressing hard on why they are blocking much-needed initiatives to help Americans.

Continuing to reduce inflation and putting money in people’s pockets, expanding the work force through affordable child care, lowering housing costs by increasing supply, raising taxes on the superwealthy, tackling corporate price gouging — this is not a progressive wish list.

It’s the unfinished business of the Biden agenda, and the way to help families and win elections.

The 2022 midterms proved that Democrats can beat Republican extremism. Instead of capitulating to election deniers, we should keep fighting for working families — because when we fight for working people, we win.

Petition: Tell Congress to make insulin affordable

Dear Friends,

For parents whose kids have Type 1 diabetes, every day can be a battle, trying to keep their kids safe and healthy. Insulin is an important part of that, but many families are seeing insulin spike in cost and become completely unaffordable. 25% of diabetics report “rationing” their insulin because of cost, which can risk serious health complications and even death.

Diabetes affects people of all ages, races, genders, and classes. People who need insulin range from 8-year-olds who have just been diagnosed with Type 1 diabetes to grandmothers who have lived with Type 2 diabetes for decades. Insulin should be available and affordable to everyone who needs it, but right now it’s not.

There is something we can do about this. The House of Representatives recently passed the Affordable Insulin Now Act, which would cap the co-pay for insulin at $35. Now we need the Senate to pass this bill.

Please sign my petition telling the Senate to support the Affordable Insulin Now Act.

Rising insulin costs have been a problem for years. But now we’re seeing that rates of diabetes are soaring among people who have had COVID, including kids who are almost three times as likely to develop diabetes if they’ve had COVID. If we don’t do something now, future generations will continue to pay for our short-sightedness.

Diabetes is a relatively common and manageable chronic illness. But the average cost of insulin has tripled since 2009, making diabetes the most expensive chronic illness to treat.

It doesn’t have to be this way. Congress can and must act now to make sure people have access to affordable insulin.
