Warren challenger in bitter battle with ex-partner over $1M from hernia settlement

GOP nominee John Deatonwho moved out of Rhode Island earlier this year to challenge Warren, a two-term Democrat — is an attorney who’s previously been in the news for his work on consumer litigation, including a fight with the retailer Claire’s over asbestos in its products.

But Deaton’s role in a high-profile class action lawsuit — and the question of how much money he should get for his work on it — is still unresolved a decade after the case was settled. As of last week, the matter remained pending before the R.I. Supreme Court — one of at least seven courts where the two sides have faced off over the past decade.

“[T]his is an extraordinary dispute between two attorneys that exceeds all bounds of reasonable behavior,” wrote Mark Whittington, a retired state justice in Texas, after completing arbitration in the case in 2022. “Both sides have engaged in unprofessional conduct and their actions have benefited neither themselves nor their clients.”

In a court order last year, Rhode Island U.S. District Magistrate Judge Patricia Sullivan echoed Whittington. She wrote that while her involvement in the case hadn’t been as extensive as his, “I have seen nothing that would cause me to disagree with these harsh sentiments.” She called the whole situation as “a messy fight.”

And in a decision issued this past August, Texas 11th District Court of Appeals Justice W. Stacy Trotter described the dispute as both an “ongoing feud” and a “quagmire.”

“At times, minor disagreements and contrasting views evolve into lingering and contentious litigation,” Trotter wrote. “In the eyes of many, disputes of this nature are never-ending and fade into an abyss. This case — as other courts have also noted — is no exception.”

In response to questions from Target 12, Deaton spokesperson Claire Hardwick suggested the judges have a point.

“Attorney Deaton believes none of this should have happened in the first place and certainly agrees it has gone on too long,” she said. “Complex questions of jurisdiction, inconsistent rulings on the arbitration requirement, a global pandemic and many other factors contributed to the delayed resolution.”

The protracted fight traces its roots back to 2008, when Texas attorney Steven Johnson began preparing lawsuits against Rhode Island-based Davol Inc., maker of a hernia repair product called Kugel Mesh that patients alleged was defective. Johnson hired Deaton to serve as local counsel in the Rhode Island courts.

The two attorneys had a falling out in 2014 after Deaton alleged Johnson failed to disclose the terms of a tentative settlement agreement, according to court documents. The pair began fighting over the extent of Deaton’s work in the case and whether he should have access to confidential information about the settlement terms.

A Providence attorney representing Johnson didn’t respond to a request for comment from Target 12.

In 2016, Deaton secured a $1 million lien on funds from the settlement in R.I. Superior Court, arguing he might be owed the money. That led Johnson and several clients whom Deaton had been representing to terminate Deaton as their counsel.

Meanwhile, Deaton and Johnson began battling in Texas over a binding arbitration proceeding to settle his fees. Whittington, the arbitrator and retired judge, determined in 2022 that Deaton was entitled to $135,000 in the portion of the dispute before him.

Whittington estimated that the maximum amount Deaton could receive in fees from the settlement was about $400,000. Yet, he wrote, Deaton and Johnson each had “inexplicably” spent more than $1 million battling over the six-figure sum.

Whittington’s arbitration ruling was upheld in August by Texas appellate court judge Trotter. He wrote that Deaton was seeking “an exorbitant amount of the settlement funds” through his $1 million lien, and said the “actual and unfortunate result” was that victims of the faulty mesh devices hadn’t gotten all the money they deserved.

Trotter also ordered Deaton to cover the costs of the appeal.

Hardwick said Deaton had wanted the $1 million lien to apply only to money for attorney fees, not victim payouts, adding that the amount “represented less than one-seventh of the attorney fees Johnson received for the hernia mesh settlements relevant to this matter.”

In addition, Deaton at one point financed a legal malpractice lawsuit against Johnson brought by a hernia mesh victim with whom Deaton had previously worked closely. An arbitrator in Texas rejected those claims, and a federal judge later upheld the arbitrator’s ruling, according to court documents.

Sullivan — the federal magistrate judge in Rhode Island — wrote that it was “a shock” for her to discover while presiding over the malpractice suit “that a case that had been prosecuted before me with such irrational intensity was actually being financed by an attorney (Deaton) who had his own dispute with the defendants in the case.”

A federal judge in Texas earlier this year dismissed another suit Deaton brought against Johnson, and warned Deaton that he would face financial or other penalties if he filed any additional suits “of a similarly duplicative or antagonistic nature” in that jurisdiction.

Deaton’s campaign told Target 12 he doesn’t plan to appeal the Texas judge’s August decision upholding the 2022 arbitration ruling. That means the dispute will now return to Rhode Island, where the state’s highest court has paused litigation over Deaton’s request for the $1 million until the issues in Texas were resolved.

It’s unclear how soon the state Supreme Court will take any action.

Michael Yelnosky, the former dean of Roger Williams University School of Law, said disputes over fees aren’t necessarily uncommon, particularly in complex litigation across multiple states. But the conflict between Deaton and Johnson appears to have grown “unusually contentious,” he said.

“This is a serious falling out,” Yelnosky said. “For better or worse, lawyers, just like everybody else out there — they don’t always behave their best when there’s money at stake.”

Hardwick said Deaton has never litigated over attorney fees outside of the hernia mesh case, but suggested that doing so as “a routine business model for Johnson.” She also noted that Deaton has received awards for his past legal work.

“Voters can see Deaton’s track record — fighting for the working class, extensive pro bono work fighting government overreach, exposing Claire’s asbestos contaminated children’s products, as a federal prosecutor coordinating drug busts against the cartel at the southern border,” she said. “His 25 years as an attorney reflects an unblemished legal career in which he routinely pursues justice.”

SEX, DRUGS AND CRYPTO — John Deaton is launching his campaign against Elizabeth Warren, giving the state’s senior senator some more prominent — but still long-shot — competition in her bid for a third term.

website and a Facebook page for Deaton’s campaign went live over the long weekend. But unless you’re really into crypto, you’ve likely never heard of the digital-assets advocate and attorney who moved to Massachusetts last month to take on Democrat Warren, Congress’ loudest crypto critic.

We’ve already covered the basics He’s a dad to three daughters, a testicular cancer survivor and a former Marine who opened a law firm in Rhode Island representing asbestos victims. He’s renting a house in Swansea that is now his primary and full-time residence, and is selling his Barrington, Rhode Island, home for $2.5 million, according to real-estate listings and Jim Conroy, a political adviser to former Gov. Charlie Baker who is consulting for Deaton. He also plans to loan his campaign $500,000 to start.

Deaton's 314-page memoir, “Food Stamp Warrior,” says a lot more. We read it over the long weekend. Here’s what we learned....


Deaton writes that years later, “I couldn’t stop asking myself: Did he kill my friend, did he get hit with a bullet, did he live or die? 

‘COKE-FUELED SEX BENDER’ — Deaton writes that after his divorce he “went on a coke-fueled sex bender.” Using sites like “Plenty of Fish” and “Sugar Daddy” to find partners, Deaton says he would search for “women in their mid-twenties, decades younger than me.”

He met his current partner, Kristiana, when he hired her as an assistant at his law firm. “Within a couple of years of Kristi working for me,” they struck up a romance. They’ve been together for almost nine years and share a 5-year-old daughter.

OVERCOMING ADDICTION — Deaton says he “periodically battled dependency on pain pills” after being prescribed opioids following a back surgery.

CRYPTO CURIOUS — Part of what helped pull Deaton out of a self-described “mid-life crisis” was discovering crypto — and the online community of digital-asset enthusiasts that comes with it. Deaton, who has invested in Bitcoin, Ethereum and XRP, gained notoriety in the crypto world when he battled the SEC’s efforts to classify XRP as a security as part of a lawsuit against Ripple Labs.

Here’s how Deaton sees crypto: “It's a story, one much like my own: it is a story of survival and evolution, not just for the few but for the many.”

TRUMP'S 'ANTITHESIS' — Though Deaton is running as a Republican, whether he’ll embrace his party’s standard bearer (and likely 2024 presidential nominee) is unclear. In his book, Deaton references former President Donald Trump — but only to draw contrast with himself.

“I’ve always believed that money should never define someone. If anything, I’m the antithesis of Donald Trump,” Deaton writes. “You’ll never catch me being flashy or anything like that.”

Last week, residents from across Middlesex and Worcester Counties gathered in Devens to express outrage, frustration, and a pervasive sense of sadness and disappointment because our elected officials have failed to protect Nashoba Valley Medical Center from closing at the end of this month. As a resident of Bolton, I sat for three hours and listened, hoping for any glimmer of a solution. Instead, we received platitudes from those officials who thanked us for coming out but who said their hands are tied.

Days later, Gov. Maura Healey announced that a deal has been outlined which will save six of the commonwealth’s eight hospitals that fell victim to mismanagement and corporate greed by Steward Health Care. Notably, Nashoba Valley is not among them; the other, Carney Hospital in Dorchester, was the emergency center I counted on while living in Roxbury during my first year as a student at New England School of Law.

Both hospitals are vital for underserved communities that are now being ignored by state and federal politicians who claim they work in the best interests of Massachusetts. In this case, those politicians do little more than send angry letters promising oversight hearings, press conferences, or anything except the badly needed solutions to our problem. It shouldn’t be up to nurses, firefighters, and senior citizens to brave bad weather on a Thursday evening and do the jobs of the people we elected.

I went into this meeting with one point to make: our commonwealth has drained its precious resources accommodating thousands of migrants instead of paying to keep Nashoba Valley Medical Center from closing its doors on August 31st. We have already surpassed $1 billion in spending on an opaque shelter system that supports no-bid contracts and generous benefits like dry cleaning and $150-per-night hotel stays.

MORE INFLAMMATORY PROPAGANDA: 
Some of the migrants enjoying our tax dollars have even committed brutal violent crimes against women caught up in the system, and in some cases instead of arresting them the state simply transports a violent individual to another shelter.

Our state budget for the fiscal year sits at about $58 billion, and our rainy-day fund now counts more than $8 billion in its coffers. And yet, Massachusetts’ one-party ruling class can’t justify spending the money to keep open two hospitals that would cost a fraction of those sums. Before declaring bankruptcy, Steward was committed to lease contracts for its eight hospitals that cost a total of $100 million annually. Assuming those were divided equally, the cost of keeping Nashoba Valley and Carney open for an additional year would cost $25 million. That critical investment would allow their management company the time to sell both institutions to buyers who the state could insist keep a commitment to delivering high-quality, regionally equitable medical care.

A national ranking recently declared Massachusetts the top state to live in. Try telling that to the families who will soon be forced to travel extended distances for emergency care only to sit in line behind other communities. That night in Devens, I arrived to deliver one message to our officials: find a solution and do your jobs, or get out of the way.

THE DEBATE ABOUT DEBATES — Hours before the vice-presidential candidates sparred over abortion on the debate stage in New York, GOP Senate hopeful John Deaton tried to take back control of the message on an issue that’s tripped up his party in recent election cycles.

At a press conference on the State House steps Tuesday, Deaton, who’s looking to unseat Sen. Elizabeth Warren, pitched himself as a “pro-choice” candidate — pledging, if elected, to vote in favor of federal abortion rights legislation and preemptively threatening to switch parties if a federal ban ever came for a vote.

SO WHAT? 

"I will work to codify Roe versus Wade into federal law," Deaton said, adding that he would work to “broaden” the abortion rights coalition in Congress.

Deaton’s stance is rare among Republicans not running for statewide election in deep-blue Massachusetts, but he's not alone in his party in trying to tackle the narrative head-on. Several Republicans running in close House races are up with ads laying out their stances on abortion in an effort to keep Democrats from controlling the message.

While Ohio Sen. JD Vance and Minnesota Gov. Tim Walz clashed over the issue during Tuesday night’s debate, former President Donald Trump took to Truth Social to promise in an all-caps missive t o veto a federal abortion ban if it were to hit his desk as president.

Deaton, an attorney and father of three girls, has been trying to sell Warren on five “single-issue” debates, including one focused on abortion and reproductive rights. While Warren hasn’t agreed to those, both candidates are locked in for two debates later this month — on Oct. 15 and 17, just before early voting begins on Oct. 19 . Warren “looks forward to debating her Republican opponent on this and other critical issues facing the Commonwealth two weeks from today,” a spokesperson said in a statement.

Massachusetts voters a well educated, well informed...they know what Senator Warren has accomplished...

Pushing for more debates is a common tactic for underdog candidates. Two recent polls show Deaton trailing Warren by more than 20 percentage points.

Part of Deaton’s problem, according to the polls: Voters don’t know him. Warren is passing on the extra debates, he argued Tuesday because she “doesn’t want people to learn who I am.” While a single-issue debate seems off the table, playing up his unique position (among members of his party) did draw some eyes to the campaign, earning him some ink in several news outlets .

State records show Deaton was on the Rhode Island voter rolls as an independent before his registration was cancelled Feb. 14 due to his change of residency. He is listed as having voted only three times since registering in Rhode Island two decades ago, casting ballots in the 2020, 2008 and 2004 general elections.

Separately, Deaton had a yearslong fight with Barrington officials over his 2017 arrest during an altercation with his girlfriend’s ex-husband. He has since sued the town in federal court, alleging police acted unlawfully. That suit remains in active in both state court and federal appeals court, according to Barrington Town Manager Philip Hervey.

BOSTON - The three Republicans competing for the right to take on Sen. Elizabeth Warren in a fight for Massachusetts's U.S. Senate seat debated which of them was a "real" Republican rather than a "RINO" - Republican In Name Only. The GOP candidates met in their only TV debate at the WBZ-TV studios.  WHO COMPOSED SUCH A STUPID COMMENT?

Border Security

The candidates were asked how they would have voted on last winter's bipartisan budget deal to tighten border security that died in Congress without a vote after Senate Republicans answered Trump's call to kill it.

Deaton said he would have voted for the bill "because it stopped the bleeding. It's not a perfect bill...[but] James Lankford was voted number two most conservative United States Senator, and he wrote that bill. It's not perfect, but you have to stop the bleeding, and that's what I mean by loyalty - loyalty to the Constitution of the country, not a person, not a party."

Antonellis disagreed. "It was a red herring. No wonder John supports it. Donald Trump was against it. It could be solved with a phone call from the White House. In other words, all the executive orders that Biden signed mere moments after taking the pen in the White House, January 20, he unraveled that border, and Donald Trump could fix it immediately. ... And how many transgender bathrooms were in that bill? We don't even know. They put all kinds of stuff into these bills."

Cain also said he would not have supported what he called "a Chuck Schumer progressive open border bill" because it doesn't get to the heart of the matter. "If you talk to voters across Massachusetts, irrespective of their party affiliation, illegal immigration is the number one issue on their minds. People are looking for, again, a sensible solution to closing the border, adjudicating the backlog of illegal immigrants that have arrived here to this country, ending the catch-and-release program, and then figuring out how to get back to a normal, legal immigration pathway for people that want to come here the right way."

Taking on Elizabeth Warren

The candidates sparred on other issues, but on one topic there was solidarity.

"Elizabeth Warren has her fingerprints on every single horrible deed, everything coming from the White House, and so she is very complicit in the destruction of our society that we're all living through today," said Antonellis. "So whether it's the border collapse, whether it's crime, whether it's inflation, whether it's the attack on womanhood, or even the attack on our environment ... she has been absolutely directly involved with."

"She has been one of the most divisive members of the U.S. Senate since her time there. She is actually not only part of the reason that Washington is frozen, but she's part of the reason why we're deeply divided," said Cain. "She uses her partisanship and her extreme partisanship to divide people. She pits people against identity. She pits classes against each other."

Added Deaton: "She's great at fighting against the rich and the wealthy. That is not the same as fighting for the poor and the middle class. I want to uplift people. I want to bring people up, expand the middle class, bring people out of poverty, like I brought myself out of poverty... I can do that without tearing people down... and she is the queen of finger-pointing politics."

Get ready Cape Cod, because there is now enough money to build a brand new, modern bridge to replace the aging Sagamore Bridge, vastly improving a vital economic engine and public safety lifeline for the region.

The long-awaited Sagamore project in Bourne has received a nearly $1 billion boost from the federal government, the Massachusetts congressional delegation announced Friday. Added to the $722 million in previously granted federal money, plus $700 million in money set aside by the state, it's more than enough to cover the estimated $2.1 billion to replace the 89-year-old span, with some left over to put toward replacing the Bourne Bridge.

"It's so exciting! Massachusetts just hit a billion-dollar home run to start replacing the Cape Cod bridges," U.S. Sen. Elizabeth Warren, D-Massachusetts, said in a phone call Friday afternoon. "We've got enough to pay for one bridge!"

The funding, awarded by the U.S. Department of Transportation to the state Department of Transportation and the U.S. Army Corps of Engineers, amounts to $993 million through the Bipartisan Infrastructure Law Bridge Investment Program.

The grant brings the total federal investment in the Sagamore replacement to $1.7 billion. Including what the state has promised, the full bank account for replacing the Cape Cod bridges is now $2.42 billion.

The Cape Cod Canal bridges were designed and built in the 1930s by the U.S. Army Corps of Engineers, which still owns and maintains them today. The bridges initially saw one million crossings annually, with that figure shooting up to nearly 38 million today, according to the Cape Cod Commission. That level of traffic is about the same as the Golden Gate Bridge in San Francisco, which is about six times the length and twice the width.

'One of the biggest federal grants'

Warren said the total federal allocation amounts to "one of the biggest federal grants in U.S. history."

"Most of the federal funding is for much less expensive projects, or it's a much smaller fraction of the overall cost," she said.

U.S. Rep. William Keating, D-Massachusetts, noted the grant was the second largest allocation nationwide from the bridge investment program — Oregon and Washington State received about $1.5 billion to replace the Interstate 5 bridge over the Columbia River that connects the two states.

"We had to really be successful here, and we were. There is a great sense of relief," he said, talking by phone Friday. "If this was not successful, it would have pushed the project back many, many years."

The federal government so far is covering about 94% of the costs toward replacing the two bridges. Warren said the federal share of other big projects in the Bay State, like the Big Dig and the Boston Harbor cleanup, was much smaller.

Keating and Warren have worked for years alongside U.S. Sen. Edward Markey, D-Massachusetts, to secure funding for replacing the bridges. Gov. Maura Healey has also pushed for state funds and supported the efforts to win federal money.

Securing the funding, Warren said, is a monumental accomplishment, especially considering "two years ago we had zero federal dollars for this bridge."

Markey: 'Today is the big payoff'

After learning about the additional funding on Friday, Markey said, "it's like Christmas in July for Cape Cod."

"I joined the public works committee in the U.S. Senate 11 years ago this week and the Sagamore Bridge replacement has been a project for all of these years," he said by phone. "Today is the big payoff."

Keating, who's been advocating for replacing the bridges since he was elected in 2013, agreed. "The question is no longer about how to fund the replacement of the Sagamore Bridge, but when shovels will go in the ground to build it," he said.

Keating: New bridge will be economic lifeline

Replacing the bridges, Keating said, will "bring immense economic, environmental, and social benefits to the region and the entire commonwealth."

The new bridge, "will be more than just a connection between two sides of the canal, it is a lifeline for the quarter of a million people who live on Cape Cod and the economic driver that brings workers and tourists back and forth every day."

As a resident of Bourne, which is split by the canal, Keating said he is particularly cognizant of how important the bridges are.

"I live and breathe this every day," he said.

More than half the workers who fuel the region's economy travel over the bridges daily, and the Cape's hospitality industry relies on adequate access to the Cape for visitors, Keating said. Additionally, the bridges serve as essential gateways for access to the ferries that carry residents, visitors, and essential supplies to the Islands, he said.

Town of Bourne: 'involved every step of the way'

Bourne Town Administrator Marlene McCollem on Friday said town leaders are "very excited" about the final piece of funding for the Sagamore Bridge falling into place. Her office learned of the award around mid-morning on Friday, she said.

Going forward, "the town will be involved every step of the way" as the project gets started, McCollem said.

The town will be, and already is, working closely with the state transportation department and the design team for the bridge project on "how it will look and how it's going to be built," McCollem said.

Keating said some "early construction work" could get started as soon as 2026.

Warren is eager to see things progress as soon as possible. "We've got the money," she said. "Now it's up to the engineers to get this thing under way."

What improvements are planned?

The Sagamore Bridge will feature several key improvements over the current structure that will allow for greater volume and safer traffic flow.

Currently, a single crossing, Warren said, "really reminds you of not having an up-to-date, 21st century bridge."

The new Sagamore Bridge, Keating said, will essentially encompass two spans, one for traffic headed onto the Cape and one for traffic leaving it. The lanes will also be wider, Keating said, "so all of us who are now traveling with white knuckles over the bridge" to avoid either scraping the passenger side on high curbing, or side-swiping oncoming vehicles, can be more relaxed.

Plans additionally call for emergency pull-over lanes, and a safer space for bicycle and pedestrian crossings.

Will traffic be backed up during construction?

"As the construction goes forward, they're making great plans so this will not be interrupting traffic," Keating said.

According to Healey's office, the replacement project "will be fully offset from the existing bridge so that traffic may be maintained on the existing bridge during the project."

It is anticipated that the project will create more than 9,000 union construction jobs.

Is the Sagamore Bridge funding guaranteed?

"It's locked in. This is it," Warren said of the Sagamore Bridge funding. "It's already been appropriated. We knew that this money was going to be spent, but the question was who was going to get it. That's been answered now."

The challenge, the legislators say, could be in securing funds for the Bourne Bridge replacement if a new federal administration comes in that doesn't support such large investments in infrastructure.

Keating said the estimated cost of replacing the Bourne Bridge is about the same as for the Sagamore Bridge, though he hopes economies of scale can be realized.

In what officials cast as a watershed moment, the Biden administration is awarding Massachusetts nearly $1 billion toward replacing one of the two aging Cape Cod bridges, cementing the most significant piece of funding yet to help realize the multibillion-dollar project, people with knowledge of the award told the Globe.

The $993 million grant accounts for nearly half of the estimated $2.1 billion it would take to replace the Sagamore Bridge, one of the two 89-year-old structures that provide the only roads on and off the Cape.

State officials have said they plan to replace the Sagamore first, before pursuing more funding for a new span in place of the nearby Bourne Bridge. Replacing both bridges is expected to cost $4.5 billion, state officials have estimated.

The amount Massachusetts is receiving nearly matches the $1.06 billion the state and the US Army Corps of Engineers — which owns and maintains the bridges — had applied for last year through the federal Bridge Investment Program.

Consequently, the new funding effectively ensures a new bridge will be built in place of the Sagamore, federal Massachusetts lawmakers said. US Senator Elizabeth Warren on Friday said the state is “ready to put shovels in the ground,” noting that two years ago, the federal government had committed no money to the project. She called the new grant a “billion-dollar home run.”

“There’s no question: It’s all systems go,” US Representative Bill Keating told the Globe, adding the project was dependent on winning the $1 billion grant. “We would have been nowhere without it. There would be no timeline without it.”

State officials said Massachusetts has now secured more than $1.71 billion in federal funding for the project, including a $372 million grant the state won in December and another $350 million it received in a separate federal appropriations bill. Governor Maura Healey has promised up to $700 million in state money for the entire project, while the Army Corps of Engineers agreed to commit $600 million, subject to Congress appropriating the money.

In an interview Friday evening, Healey emphasized that “there’s still a ways to go” until construction, noting the state is working through environmental permitting, and that it must next select a firm to design and build the bridge.

But she said the state has “never been closer to rebuilding the bridges.”

“This is Christmas in July,” US Senator Edward Markey told the Globe, noting the Sagamore replacement is expected to be wider than the original. “This announcement means that a brand-new shiny Sagamore Bridge is going to be constructed.”

The Sagamore and Bourne bridges are considered functionally obsolete, and officials have said pursuing lengthy and costly fixes in lieu of replacement could be catastrophic to crossings that carry tens of millions of cars each year.

The bridges, which first opened to traffic in 1935, were intended to stand for just 50 years, and the Army Corps recommended in 2020 that both be replaced.

The project is a complex one. The bridges are owned by the federal government, though under an agreement with state officials, the state will take over ownership of and operate the two new spans over the Cape Cod Canal once they are built. State transportation officials said earlier this month that the first new span would be built “fully offset” from the current Sagamore Bridge, so that traffic can continue to flow over it during construction.

Officials have warned that without replacing or fixing each bridge, they’ll be forced to permanently close a lane in each direction by 2032 on the Bourne Bridge and 2036 on the Sagamore Bridge. The Healey administration has estimated that for the Sagamore Bridge alone, construction on a new bridge would begin in late calendar year 2028 and would last until late 2035 or early 2036.

Past attempts to secure federal help went nowhere. The state whiffed on $3 billion in requests to fund the replacement of both during the final months of then-governor Charlie Baker’s administration, partly because the state and Army Corps of Engineers didn’t have a fully fleshed-out financing plan.

A Department of Transportation official told state officials last year that it had identified a $630 million shortfall in the project, according to meeting notes obtained by the Globe.

That prompted Healey to change course. She said last year she’d seek to replace the bridges in a “phased process,” starting first with the Sagamore Bridge, in part because it carries nearly 17,000 more cars on average each day than the Bourne.

The nearly $1 billion grant the state is now getting, however, was crucial for anything to move forward. “This is a game-changing award for Massachusetts,” Healey said.

It remains unclear when, or whether, the state will be able to win the funding to replace the Bourne. A big factor in the state’s success rests with this year’s election, Massachusetts officials said, illustrating how something as bureaucratic as bridge funding can be tightly wound into politics.

President Biden has long been the Democratic Party’s presumptive nominee, but he is facing growing calls to step aside in the wake of his disastrous debate performance. Biden has repeatedly said he would not drop out of the race.

Warren has publicly stood by Biden, declaring that he’s the party’s nominee and touting his accomplishments, and Markey on Friday told the Globe he believes Biden is “going to be our nominee.” Healey has said Biden should “carefully evaluate” whether he remains Democrats’ best candidate to win against former president Donald Trump in November.

“The Sagamore Bridge is a done deal because Joe Biden defeated Donald Trump in 2020 and because Democrats controlled the House and the Senate. And now we have to find the funding for the Bourne Bridge,” Markey said Friday, arguing it will be “much more likely” the state can secure the funding for the Bourne Bridge with Biden in office.

“We need to make sure that Joe Biden gets reelected,” he said.

Healey declined to address the “conjecture” of what impact the 2024 presidential election could have on the state’s chances.

“We demonstrated through this application how critical this infrastructure is to Massachusetts and to the region,” she said. “I’ll continue to make that point to Washington, D.C.”

Funding to replace the Sagamore and Bourne bridges is not included in President Trump’s fiscal 2021 budget or the U.S. Army Corps of Engineers’ fiscal 2020 work plan. 

WASHINGTON — Funding for the replacement of the Sagamore and Bourne bridges is not included in President Trump’s fiscal 2021 budget or the U.S. Army Corps of Engineers’ fiscal 2020 work plan, both of which were released this week.

The exclusion prompted U.S. Sens. Edward Markey and Elizabeth Warren and U.S. Rep. William Keating, all Massachusetts Democrats, to send a strongly worded letter to Washington late Thursday calling the omission “inexplicable” and expressing “deep disappointment.”

“We are greatly disturbed by this omission of funds for the Cape Cod Canal bridges and demand answers as to how the USACE plans to finance the replacement of such vital bridges that have long outlived their usefulness,” they wrote in the letter to Mick Mulvaney, a member of the president’s Cabinet as director of the office of management and budget, and Rickey James, assistant secretary of the Army for Civil Works.

The Army Corps, in a draft version of its Major Rehabilitation Evaluation Study released in October, recommended replacing the bridges instead of rehabilitating the two 84-year-old spans. The Army Corps, which owns and maintains the bridges, determined the $1.5 billion estimated to replace them would be more cost-effective than repairing them, and work could begin as early as 2025.

The Army Corps at the time said a final report would be submitted to its headquarters this month.

“At this point, we’re focusing on completing the Major Rehabilitation Report and submitting it to our headquarters for approval,” Beth Gosselin, chief of public affairs for the U.S. Army Corps of Engineers New England District, wrote in an email to the Times. “Until we have an approved report, we can’t move to the budgeting process. At this time, we are funded to continue to maintain the bridges in order to ensure the continued safety of the traveling public.”

Although there was no money in the budgets for the replacement project, the Army Corps Work Plan does allocate $11.9 million for the Cape Cod Canal Federal Navigation Project, and the president’s budget allots $12.4 million for ongoing operations and maintenance of the canal.

The federal legislators, however, said in the letter that they had previously requested an allocation of Army Corps funds in fiscal 2020 as a “significant down payment and a responsible long-term investment,” so that if a final decision on the replacement recommendation were made this spring, the project could begin immediately to avoid delays and increased costs.

“We are concerned that this decision reflects a failure to understand the urgency of the situation for the Cape & Islands,” the region’s federal delegation wrote. “The residents of this region cannot wait multiple years for this project to begin. The Bourne and Sagamore are not only vital links to the beating heart of the Massachusetts tourism economy, but critical evacuation routes in the event of an emergency. Two new structures are needed without delay in order to protect both the local economy and public safety.”

Keating hit hard at the Trump administration in a message to the Times on Thursday night.

“Congress has repeatedly appropriated funds to the Army Corps to perform necessary projects like continuing the ongoing work on the Cape Cod Canal bridges,” he said. “This Administration, however, has once again ignored the will of Congress and instead decided to gut the Army Corps’ budget for the second year in a row, including blatantly ignoring the work needed on the canal bridges. The Administration’s continued refusal to fund these vital infrastructure projects has a direct, negative impact on the daily lives of the 250,000 Massachusetts residents who depend on the Bourne and Sagamore bridges.”

“We are in it for the long haul,” said Wendy Northcross, CEO of the Cape Cod Chamber of Commerce. “We know it is not going to be a simple task to get the funding, but I think we will prevail eventually. The federal government owns the bridges, and they have a responsibility to help us figure this out.”

Northcross added that the nation as a whole needs an infrastructure bill for transportation and water infrastructure.

“It’s disappointing that the Trump administration has gone back on the Army Corps’ commitment to replace the aging bridges that span the Cape Cod Canal,” said state Sen. Julian Cyr, D-Truro. “While the administration has neglected to fund new Sagamore and Bourne bridges, I have confidence that our federal delegation will deliver for the Cape and Islands on these critical projects.”

POLITICO Massachusetts Playbook: Warren’s (likely) GOP challenger


CRYPTO ENTERS THE SENATE RACE CHAT — A cryptocurrency advocate and attorney is likely to challenge Sen. Elizabeth Warren, giving Republicans a standard-bearer against the prominent progressive and the digital-assets industry a conduit through which to take on Congress’ chief crypto critic.

John Deaton is prepared to seed his campaign with $500,000 should he run, a person familiar with his plans told Playbook.

Deaton is a virtual unknown in Massachusetts political circles. But he comes onto the scene with a hardscrabble backstory and a crypto fanbase. A former U.S. Marine who hails from a Detroit enclave, Deaton overcame an impoverished childhood to graduate law school. He started his own firm in Rhode Island representing asbestos victims. He is the father of three daughters, a cancer survivor and the author of a memoir, “Food Stamp Warrior." The Boston Globe first reported his interest in the race.

He telegraphed a potential run against Warren last year, writing in a post on X last October that his “biggest regret” at that moment was not buying a house he had looked at in Massachusetts instead of his residence in Barrington, Rhode Island.

“Had I bought the Massachusetts house, I would [100 percent] run against this [gaslighting], self serving, hypocrite,” he wrote in response to an article about Warren expressing concerns about Hamas raising money through crypto before attacking Israel on Oct. 7.

Deaton now lives in Swansea , according to Jim Conroy, a political adviser to former GOP Gov. Charlie Baker who is consulting with Deaton on his possible campaign. He would run as a Republican, Conroy said.

He would be a longshot against Warren , who remains popular in this state — roughly 54 percent of respondents to a recent Suffolk University survey approved of her job performance, compared to 35 percent who disapproved. She's also a formidable fundraiser who started the election year with $3.9 million in the bank.

But Republicans hope Warren , who finished third in her home state’s 2020 presidential primary and has seen lower approval ratings in other polls, is weaker than she seems.

And she could face a flood of crypto money if Deaton gets in . While Conroy said Deaton wouldn’t be basing his candidacy around his cryptocurrency advocacy, he already has a track record of criticizing Warren’s views on digital assets and could win the backing of an industry that is trying to fight Warren in Washington over her proposals to subject it to tougher anti-money-laundering rules.

The industry is also ramping up an aggressive effort to influence the 2024 elections. A crypto-backed super PAC that has more than $80 million in the bank placed a multimillion-dollar ad buy this week attacking Democratic Rep. Katie Porter, a Warren protégé, in California’s U.S. Senate primary.

Deaton’s crypto cred could also help attract support — and money — from corners of the GOP aligned with the digital asset industry. In Ohio, a pro-crypto challenger to Democratic Sen. Sherrod Brown, another industry critic, was endorsed by the conservative Club for Growth in part thanks to his stance on digital assets and blockchain.

A spokesperson for Warren said the state's senior senator is “taking nothing for granted” and “has a strong track record of delivering for working families and continues to fight hard for the people of Massachusetts.”
