August 9, 2023 HEATHER COX RICHARDSON AUG 10 New York Times journalists Maggie Haberman, Charlie Savage, and Luke Broadwater yesterday reported that in a memo dated December 6, 2020, Trump lawyer Kenneth Chesebro laid out a plan to overturn the results of the 2020 presidential election that he acknowledged was “a bold, controversial strategy” that he believed the Supreme Court would “likely” reject.  Still, he presented the plan—while apparently trying to distance himself from it by writing “I’m not necessarily advising this course of action”—because he thought it “would guarantee that public attention would be riveted on the evidence of electoral abuses by the Democrats, and would also buy the Trump campaign more time to win litigation that would deprive Biden of electoral votes and/or add to Trump’s column.”   The plan was essentially what the Trump campaign ultimately tried to pursue. It called for Trump-Pence electors in six swing states Biden had won to meet and vote for Trump, and then to make sure that in each of those states there was a lawsuit underway that “might plausibly” call into question Biden’s victory there. Then, Vice President Mike Pence would take the position that he had the power not simply to open the votes but also to count them, and that the 1887 Electoral Count Act that clarified those procedures was unconstitutional.  Key to selling this strategy, Chesebro wrote, was messaging that constructing two slates of electors was “routine,” and he laid out a strategy of taking events and statements out of context to suggest support for that messaging.  This was, of course, a plan to deprive American voters of their right to have their votes counted, as the federal grand jury’s recent indictment of former president Trump charged, but Chesebro concluded: “it seems advisable for the campaign to seriously consider this course of action and, if adopted, to carefully plan related messaging.”  Three days later, Chesebro wrote specific instructions to create those fraudulent electors, and they were off to the races.  Chesebro is identified as Co-Conspirator 5 in the grand jury’s recent indictment of Trump.  It is an astonishing thing to read this memo today.  Forty-nine years ago, on August 9, 1974, President Richard Nixon wrote one line to Secretary of State Henry Kissinger: “I hereby resign the Office of President of the United States.” In late July the House Judiciary Committee had voted to recommend articles of impeachment against the president for obstruction of justice, abuse of power, and contempt of Congress for his attempt to cover up the involvement of his people in the June 1972 burglary of the Democratic National Committee headquarters at the Watergate Hotel in Washington, D.C. The Watergate break-in was part of the Nixon campaign’s attempt to rig the 1972 election, in this case by bugging the Democrats’ headquarters, and Republicans wanted no part of it. When the White House produced a “smoking gun” tape on August 5, revealing that Nixon had been in on the cover-up since June 23, 1972—and implying that he had been in on the bugging itself—those Republicans who had been defending Nixon abandoned him.  On the night of August 7, 1974, a group of Republican lawmakers led by Arizona senator Barry Goldwater met with Nixon in the Oval Office and told him that the House as a whole would vote to impeach him and the Senate would vote to convict. Nixon decided to step down. Although Nixon did not admit any guilt, maintaining he was resigning only because the time it would take to vindicate himself would distract from his presidential duties, his replacement, Gerald R. Ford, granted “a full, free, and absolute pardon” to Nixon “for all offenses against the United States which he…has committed or may have committed or taken part in during the period from January 20, 1969, through August 9, 1974.” Ford said that the trial of a former president would “cause prolonged and divisive debate over the propriety of exposing to further punishment and degradation a man who has already paid the unprecedented penalty of relinquishing the highest elective office of the United States.” Only fifteen years later, the expectation that a president would not be prosecuted came into play again when members of President Ronald Reagan’s National Security Council ignored Congress’s 1985 prohibition on aid to the Nicaraguan Contras who were fighting against the socialist Nicaraguan government. The administration illegally sold arms to Iran and funneled the profits to the Contras.  When the story of the Iran-Contra affair broke in November 1986, government officials continued to break the law, shredding documents that Congress had subpoenaed. After fourteen administration officials were indicted and eleven convicted, the next president, George H. W. Bush, who had been Reagan’s vice president, pardoned them on the advice of his attorney general William Barr. (Yes, that William Barr.) The independent prosecutor in the case, Lawrence Walsh, worried that the pardons weakened American democracy. They “undermine…the principle…that no man is above the law,” he said. Pardoning high-ranking officials “demonstrates that powerful people with powerful allies can commit serious crimes in high office, deliberately abusing the public trust without consequences.”  Walsh’s warning seems to be coming to life. January 26, 2023 HEATHER COX RICHARDSON JAN 27 The National Archives and Records Administration (NARA) today asked six former presidents and their vice presidents to look to see if they have any presidential records, including documents marked classified, in their possession. It sent the letters to representatives for former presidents Donald Trump, Barack Obama, George W. Bush, Bill Clinton, George H.W. Bush, and Ronald Reagan and former vice presidents Mike Pence, Joe Biden, Dick Cheney, Al Gore, and Dan Quayle. It did not make a similar request to former president Jimmy Carter because although he was the one who signed the Presidential Records Act into law, it did not go into effect until he left office. This request illuminates the crucial importance in our society of disinformation: deliberate lies or misdirection to convince people of things that are not true.  At this point, documents bearing classification markings have turned up in the possession of Trump, Biden, and Pence. The NARA request suggests the possibility that other high-ranking officials also have documents that they are unaware they hold. Trump and his allies insist that the special counsel investigating him for potential criminal behavior means that he is being treated differently than the others, with the implication that he is being treated unfairly. But the issue has never been about the documents themselves, although it is a problem that any of the former officials have documents marked classified. The issue was that NARA repeatedly asked Trump to produce documents it knew he had, and that he repeatedly refused even after being subpoenaed. Finally, the Department of Justice felt obliged to get a court order to search his property, and even now his lawyers refuse to sign off on paperwork saying he has turned in all the documents he stole. In contrast, Biden and Pence apparently did not know they had any documents with classified markings, alerted NARA as soon as they realized it, and have cooperated with authorities.  The cases are not the same. For a long time now, the right wing has muddied the political waters by creating such confusion over things that should be clear—flooding the zone with sh*t, as Trump advisor Stephen Bannon put it—that people can’t figure out what is really going on.  An attempt to continue that strategy is what’s behind the House Republicans’ establishment of a select subcommittee on the “weaponization” of the federal government, positioned under the Committee on the Judiciary. The representatives Speaker Kevin McCarthy (R-CA) has put on that committee are grandstanders, and they have indicated they plan to argue that the Biden administration has politicized the government. Considering the representatives involved, we can expect lots of yelling and sound bites for right-wing media, designed to build the narrative they want their voters to believe. But the truth is that it was the Trump administration that sought to weaponize the government against their perceived enemies. News broke today that Trump’s attorney general, William Barr, deliberately tried to use the Department of Justice to undermine the officials who had—according to the Justice Department’s own independent inspector general, Michael E. Horowitz—launched the Russia investigation properly and with good reason.   The story, by Charlie Savage, Adam Goldman, and Katie Benner in the New York Times, also told us more. After the report by Special Counsel Robert Mueller detailing contacts between the Trump campaign and Russian operatives came out, Barr consistently spun the information inaccurately to make the best possible case for Trump. He convinced many Americans to think that there was nothing between the Trump campaign and Russia, although in fact Mueller and the Senate Intelligence Committee’s report that came out afterward concluded the opposite.  Barr undermined not only the Mueller report but also the inspector general’s report, ignoring its findings and telling the press—inaccurately—that the FBI had opened the Russia investigation on the “thinnest of suspicions that, in my view, were insufficient,” or “without any basis.” (In fact, the FBI opened the inquiry when an Australian diplomat warned that a member of the Trump campaign had boasted that Russian operatives had “dirt” on Democratic candidate Hillary Clinton. Australia and the United States, along with Canada, New Zealand, and the United Kingdom, are part of an intelligence alliance known informally as Five Eyes. It was this information that Horowitz found compelling enough to open an investigation.)  After the Mueller report’s release, Barr appointed a special counsel, John Durham, to investigate the investigators. Durham used the very tactics of which the Republicans’ accused the Democrats, using bad information to try to get information on a private citizen. But no matter how hard he tried, he did not, in fact, turn up information indicating the investigators had conducted themselves improperly.  What Durham did find, though, were accusations from Italian officials that Trump himself might have engaged in financial crimes. The accusations were too serious for him and Barr to ignore. Barr authorized Durham’s inquiry to become a criminal inquiry, but here’s the kicker: when news of that new phase became public, Barr sat back as media spun the new criminal inquiry as proof of misbehavior on the part of those who had conducted the Russia inquiry. Trump even told followers that the criminals were former president Barack Obama, former vice president Joe Biden, and leading FBI and intelligence officials. The actual target of the criminal investigation was Trump himself.  In the end, Durham never found anything to contradict Inspector General Horowitz’s report saying the Russia investigation was begun properly, and the only cases he brought failed. But the cozy relationship between him and Barr violated department policy for special counsels, according to legal analyst Lisa Rubin, as they allegedly discussed the case frequently, including occasionally over drinks. A special counsel is supposed to be independent.  The New York Times article details how the Trump administration worked overtime to use the apparatus of government to convince the American people that there was nothing to the Russia investigation, although repeated reports said otherwise. This story seems especially relevant in light of the arrest this week of Charles McGonigal, who was the special agent in charge of counterintelligence in the FBI's New York Field Office from 2016 to 2018 and, before that, was the section chief of the Cyber-Counterintelligence Coordination Section at FBI headquarters in Washington, D.C. McGonigal supervised and participated in investigations of Russian oligarchs. McGonigal is charged with working for Oleg Deripaska, a Russian oligarch close to Vladimir Putin. Deripaska was also a close associate of political operative Paul Manafort, who ran Donald Trump’s 2016 presidential campaign.  In a powerful Twitter thread today, scholar of authoritarianism Timothy Snyder noted that authorities, as well as the American people, have not taken the threat of Russian influence in our politics seriously enough. He pointed out that in 2016, McCarthy himself i said he thought Putin was paying Trump, and now, just after the McGonigal story broke, McCarthy threw Adam Schiff—who was key in chasing down Trump’s machinations over Ukraine—off the House intelligence committee. “Schiff is [an] expert on Russian influence operations,” Snyder wrote. “It exhibits carelessness about national security to exclude him. It is downright suspicious to exclude him now.”  Meanwhile, newly elected House Republican Cory Mills of Florida, endorsed by Trump, handed out defused grenades today on the floor of the House. Mills is an election denier who boasted on his website that he sold tear gas used on Black Lives Matter protesters. Mills accompanied the grenades with a note suggesting he was sending them because McCarthy has put him on the Armed Services and Foreign Affairs Committees. But, as with most of the performances coming out of the right wing these days, that explanation seems intended to be misdirection. August 25, 2022 Heather Cox Richardson Aug 26 Today, legal news about the former president and members of his team revealed a group of people who appear to have ignored the law.   The stories began with the release of the Department of Justice (DOJ) memo written for Trump’s attorney general Bill Barr arguing that Trump should not be charged with obstruction of justice over his attempts to shut down the Russia investigation despite his firing of Federal Bureau of Investigation (FBI) director James Comey, urging of witnesses not to “flip,” hints of pardons to those who stayed quiet, and so on. The memo seems clearly to have been a whitewash to justify Barr’s predetermined decision not to prosecute, illustrating the dangerous politicization of the DOJ.   The memo argued that because special counsel Robert Mueller did not find enough evidence to charge Trump with conspiring with Russia, there was no crime committed, and thus Trump could not be charged with obstruction. In fact, Mueller noted in the report that the investigation was hampered by the president’s allies who refused to cooperate. Andrew Weissman, a 20-year veteran of the Department of Justice who worked on the Mueller investigation, concluded: “Key ‘reasoning’ of…memo: if you successfully obstruct an investigation, you cannot be charged with obstruction as you were not charged with the crime under investigation. Future defendants will have a field day with this memo unless DOJ repudiates it soon.” Harry Litman, former U.S. attorney and now legal affairs columnist for the Los Angeles Times, noted that the principal author of the memo, Steven Engel, “is too good a lawyer not to have known what was going on. In a way, the most important words in the memo are the first 3: ‘at your request.’ This was a political mission.”  And then there is the attempt of Republican operatives to smear their opponents. Today, the U.S. attorney’s office for the Southern District of New York announced that two people have pleaded guilty to stealing the diary and other personal property of then-candidate Joe Biden’s daughter and selling it for $40,000 to James O’Keefe’s Project Veritas. In the process, they transported the material across state lines and then, at the request of the person to whom they sold it, went back to get more. They pleaded guilty to conspiracy to commit interstate transportation of stolen property, and will cooperate with authorities. The attempt to overturn the 2020 presidential election results is also in legal news.  Senator Lindsey Graham (R-SC) is arguing in court that the judge should not let a grand jury question the senator “on all the topics” covered by its recent subpoena of his testimony in the investigation of the Trump campaign’s attempt to overturn the 2020 presidential election results in Georgia. Graham argues that the Speech or Debate Clause of the U.S. Constitution, which says that congress members “shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place,” means he cannot be questioned about his two phone calls to Georgia secretary of state Brad Raffensperger about throwing out mail-in ballots in that state.  For Graham’s argument to prevail, he will have to convince the court that his calls to Raffensperger were part of his legitimate congressional work, rather than part of the efforts of Trump’s campaign to overturn the election, actions outside the scope of Graham’s congressional duties.  Lawyer Kenneth Chesebro, who helped to invent the false electors plan to overturn the results of the 2020 election, is refusing to talk to the grand jury, arguing that he has an attorney-client relationship with the Trump campaign and saying the campaign had “instructed” him to maintain confidentiality. But Chesebro never received any payment, and it is unclear whether he was officially working for the campaign.  Meanwhile, Fulton County, Georgia, district attorney Fani Willis filed petitions today to require Trump chief of staff Mark Meadows, Trump lawyer Sidney Powell, Meadows ally James “Phil” Waldron, and Trump campaign advisor Boris Epshteyn to testify before the special grand jury next month.  Finally, the top secret documents Trump stole from the government: Today the DOJ submitted to the court a redacted version of the affidavit it used to obtain a search warrant for Trump’s Florida property Mar-a-Lago earlier this month. The judge has ordered the release of the document by noon tomorrow. Trump had publicly demanded the release of the affidavit but had not actually asked the court to release it. Instead, he has whipped up his followers against the FBI.  With these headlines from the Republican Party, and coming on the heels of a spectacular few months for the Democrats, the Biden administration came out today swinging against MAGA Republicans. First, after a day of Republican congress members railing against yesterday’s educational loan forgiveness of up to $20,000 for Pell Grant recipients and $10,000 for others, the White House tweeted a thread of those members alongside the amount of Paycheck Protection Program (PPP) money those individuals were forgiven.  Representative Marjorie Taylor Greene (R-GA) said: “For our government just to say ok your debt is completely forgiven.. it’s completely unfair.” Greene had $183,504 in PPP loans forgiven. Representative Vern Buchanan (R-FL) said: “Biden’s reckless, unilateral student loan giveaway is unfair to the 87 percent of Americans without student loan debt and those who played by the rules.” Buchanan had more than $2.3 million in PPP loans forgiven. Representative Markwayne Mullin (R-OK) said: “We do not need farmers and ranchers, small business owners, and teachers in Oklahoma paying the debts of Ivy League lawyers and doctors across the U.S.” Mullin had more than $1.4 million in PPP loans forgiven. Representative Kevin Hern (R-OK) said: “To recap, in the last two weeks, the ‘Party of the People’ has supercharged the IRS to go after working-class Americans, raised their taxes, and forced them to pay for other people's college degrees.” Hern had more than $1 million in PPP loans forgiven. Representative Mike Kelly (R-PA) said: “Asking plumbers and carpenters to pay off the loans of Wall Street advisors and lawyers isn’t just unfair. It’s also bad policy.” Kelly had $987,237 in PPP loans forgiven. Representative Matt Gaetz (R-FL) said: Everyone knows that in a $60 Billion+ European land war, it's always the last $3 Billion that kicks in the door….” Gaetz had $482,321 in PPP loans forgiven.  Then Biden gave a barn-burning speech to the Democratic National Committee in Rockville, Maryland, clearly dividing the Republican Party between the MAGAs and mainstream Republicans. The MAGA philosophy is “semi-fascism,” he said, and we are seeing either its beginning or death knell.  “I want to be crystal clear about what’s on the ballot this year. Your right to choose is on the ballot this year. The Social Security you paid for from the time you had a job is on the ballot. The safety of our kids from gun violence is on the ballot…. The very survival of our planet is on the ballot. Your right to vote is on the ballot. Even…democracy.” “The MAGA Republicans don’t just threaten our personal rights and economic security,” he said. “They’re a threat to our very democracy. They refuse to accept the will of the people. They embrace…political violence.
