In 'Stunning' Reversal, Wisconsin Throws Out Case Against Puppy Mill Rescuers
“The state and Ridglan are acknowledging what we knew to be true: we have the right to rescue suffering animals from abuse because they are sentient beings, not things,” said one animal rights campaigner.

In what one animal rights advocate called a "stunning admission" by Wisconsin prosecutors, the state on Friday dropped its case against three activists accused of rescuing beagles from a large dog breeding facility.

The prosecution, evidently, "prefers to let the defendants walk free than allow the world to see the dire conditions of dogs at Ridglan, and the state trying to jail activists for a heroic act of compassion," said Chris Carraway, an attorney with the Animal Activist Legal Defense Project who represents one of the defendants.

Carraway's client, Paul Darwin Picklesimer, allegedly joined Eva Hamer and Wayne Hsiung in an "open rescue" operation at Ridglan Farms in Dane County, Wisconsin in 2017.

In an open rescue, activists do not hide their identities as they enter facilities including breeding, agricultural, and animal experimentation centers and document the conditions before removing some or all of the animals. The tactic is aimed at publicizing the conditions animals are forced to endure in the facilities.

In the Ridglan case, the three defendants, who are members of the international animal rights group Direct Action Everywhere (DxE), found dogs who were crammed into small cages that put them at risk of foot and leg injuries; provided no access to the outdoors; forced to live in continuous 24-hour lighting; and living with "noxious air and feces building up beneath the cages."

The group wrote in a report that they "found many dogs wailing, howling, and barking, while others were lethargic and utterly passive... There were no soft beds, no toys, no access to sunlight, no human companionship."

The activists removed three beagles who appeared to be in particular distress, obtained veterinary care for them, and found homes where the dogs are still living, according to DxE. Picklesimer, Hamer, and Hsiung were arrested a year later after they shared information about the operation on social media.

They were charged with one count each of felony burglary and felony theft and faced a potential maximum sentence of 16 years in prison and a $35,000 fine before the state called for the charges to be dropped. Judge Mario White granted the dismissal at a hearing on Friday.

The prosecution said in a motion filed this week that it wanted to prevent the defendants from using a "defense of others" defense, arguing that they should not be protected from liability because they rescued "things" instead of people.

"The state and Ridglan are acknowledging what we knew to be true: we have the right to rescue suffering animals from abuse because they are sentient beings, not things," said Hsiung.

Carraway suggested the state likely wanted to avoid a trial in which the defendants would present the conditions they found during their investigation at Ridglan Farms.

"Each time an open rescue case goes to court, the public can clearly see that the real crime is animal cruelty, not animal rescue," said Carraway.

More than 100 animal rights advocates had been planning to travel from around the country to attend the trial.

"It is more important now than ever that we keep the pressure on to get justice for these animals," said DxE.

Hsiung noted that state inspectors found in 2016 that Ridglan was subjecting dogs to "improper caging conditions" and warned the facility to stop the practice to avoid harming dogs' feet and legs.

As recently as last year, federal inspectors found that the problem persisted at Ridglan.

Hsiung called for a special prosecutor to be appointed by the state to investigate Ridglan so its practices can be made public.

"This legal battle has just begun," he said.

Buttigieg hits back at Speaker Johnson’s criticism of Biden’s SOTU address

Secretary of Transportation Pete Buttigieg fired back Friday at House Speaker Mike Johnson’s (R-La.) criticism that President Biden’s State of the Union address was “hyperpartisan” and “vitriolic.”

During a Friday morning appearance on “CNN This Morning,” Buttigieg said some of Johnson’s comments were “literally false,” listing bipartisan legislation that Biden passed through Congress and signed into law.

“Well, the Speaker’s comments are literally false, because the president talked about a bipartisan infrastructure, a bipartisan border bill, his bipartisan unity agenda on confronting things like fentanyl and cancer,” Buttigieg said.

“It’s a matter of fact. Pretty much everything — as far as I recall — that the president mentioned, there’s something probably 60-70 percent of Americans or more would support.”

The Transportation secretary acknowledged that Biden scrutinized Republicans in Congress over their support for slashing tax rates for wealthy individuals, but emphasized that the majority of U.S. voters side with Biden on the issue.

“But while that might be an issue that has strong partisan lines in Congress, out in the country, most Americans — Democrats, independents and Republicans — disagree with congressional Republicans’ agenda to cut taxes for the wealthy and agree with the president that it is wrong for billionaires in our biggest corporations to be paying a lower tax rate than firefighters and teachers,” he said.

Johnson said Biden’s speech was “overly partisan” while talking to reporters after the address Thursday night, explaining why Biden got heckled during the speech by a handful of GOP lawmakers.

“People got very emotional tonight because it was an overly partisan speech and it was filled, full of information that is just objectively not true. And so you saw the visceral reaction, I think, from people in the chamber, and I suspect that a lot of people at home were feeling that same frustration,” Johnson said Thursday night.

Biden had a fiery exchange with Rep. Marjorie Taylor Greene (R-Ga.), one of his biggest critics on Capitol Hill, during the speech over Laken Riley, a Georgia college student who was killed by a man who illegally crossed the border, according to police.

Trump's Attorneys Post Bond in $83 Million Award to Writer in Defamation Case

 




Former President Donald Trump has secured a bond sufficient to support an $83.3 million jury award granted to writer E. Jean Carroll during a January defamation trial stemming from rape claims she made against Trump, his lawyer said Friday as she notified the federal judge who oversaw the trial that an appeal was underway, the Associated Press reports. Attorney Alina Habba filed papers with the New York judge to show that Trump had secured a $91.6 million bond from the Federal Insurance Co. She simultaneously filed a notice of appeal to show Trump, the 2024 Republican presidential front-runner, is appealing the verdict to the 2nd U.S. Circuit Court of Appeals.

In a scathing statement from the bench, Judge Royce C. Lamberth said Thursday that he was worried about “further danger to our country” because of Little and others’ “shameless attempts ... to misinterpret or misrepresent what happened” on Jan. 6, 2021. While his audience was Little, a 53-year-old North Carolina truck driver, the judge also alluded to comments made by Republican lawmakers, including what he called a “preposterous” statement from Rep. Elise Stefanik (N.Y.) calling Jan. 6 defendants “hostages.”

“I have been shocked to watch some public figures try to rewrite history,” Lamberth said. “It’s up to the court to tell the truth. I hope a little truth will go a long way.”

Little was first sentenced by Lamberth in early 2022 to 60 days in prison and three years of probation after pleading guilty to illegally parading at the Capitol. But Little’s public defenders argued prison time and probation can’t be combined for a single “petty” misdemeanor charge. The U.S. Court of Appeals for the D.C. Circuit agreed.

When the ruling came down in August, Little had already served his time behind bars and about half his probation, so he asked to be set loose. Instead, Lamberth sentenced him anew to two more months in prison, saying Little had shown no remorse or respect for the criminal justice system since the riot.

“This is a matter of right versus wrong,” Lamberth said. “Mr. Little cannot bring himself to admit he did the wrong thing.” Little, appearing by video from his home in Claremont, N.C., shook his head and rolled his eyes as the judge spoke, occasionally muttering to himself.

A Reagan appointee, Lamberth said that defendants who refuse to accept responsibility are common. “But in my 37 years on the bench, I cannot recall a time when such meritless justifications of criminal activity have gone mainstream,” he said.

A probation officer wrote to the court that Little failed to perform required tasks and displayed an “inability to fully accept responsibility for his actions” and “behavior consistent with entitlement.” When reminded of the $500 restitution he owed, the officer said, “Mr. Little voices invalid excuses and circles the conversation back to how he feels his voice is being silenced.”

Joshua Carpenter, representing Little in court, said there were some “miscommunications” and his client has since put a check in the mail.

Since his first sentencing, prosecutors noted, Little had also used Facebook to falsely claim FBI involvement in the Jan. 6 attack, describe himself as a “political prisoner,” and compare himself to Vietnam veterans “shunned ... by armchair soldiers of family and ‘Friends’ who weren’t there.” He also promoted a campaign baselessly claiming Democrats will try to “rig” the 2024 election.

In his own brief comments, Little told the judge that “even though it’s my constitutional right,” he would not attend any more political rallies. “I’m a little scared to, honestly,” he said. “I’m getting too old for this stuff.”

Lamberth responded that Little “has a First Amendment right to believe the 2020 election was stolen; he has the right to express that view too.” But, he said, freedom of speech “does not give anyone ... the right to engage in riotous behavior at the U.S. Capitol.” He pointed out that thousands of Donald Trump supporters watched the former president speak on Jan. 6 and committed no crimes afterward.

He said misdemeanor defendants like Little must understand that they could not have entered the Capitol if other protesters had not assaulted police officers: “Not everyone present that day was violent, but violence is what let them into the Capitol.”

The judge expressed particular ire that Little had referred to Jacob Chansley, the so-called QAnon Shaman, as a “fellow persecuted and prosecuted J6 Patriot” on Facebook. “I happen to be the judge who had Mr. Chansley’s case, and I know that he was neither persecuted nor prosecuted improperly or unlawfully,” Lamberth said. The judge had a similar reaction when Chansley himself tried to withdraw his guilty plea by citing snippets of video footage from the riot that had been played on Fox News.

“I have been dismayed to see distortions and outright falsehoods seep into the public consciousness,” Lamberth said Thursday.

Lamberth is one of the toughest sentencers in the D.C. federal court for Jan. 6 defendants, going above government sentencing recommendations more often than any judge other than the judge handling Trump’s case, Tanya S. Chutkan.

About five dozen other Jan. 6 defendants were given similar split sentences, but not all appealed them. Some have asked for and received early termination of their probation. A magistrate judge in the courthouse recently ruled that giving a harsher punishment after a sentence has been deemed illegal would be a violation of the constitutional prohibition on double jeopardy.

Carpenter said in court he plans a second appeal for Little on that issue.
