The line I keep rereading is from Judge Ali’s ruling. Asked how the regime’s fingerprint policy stops frivolous claims, its own lawyer told him, “I don’t have an answer to that right now.” Nine words, and not one of them explains how. Help us get moments like that in front of undecided voters in these last three weeks. Give a gift subscription or become a Founding Member here.
Trump Doesn’t Want You To Read What His Lawyers Told The Judge

We are only three weeks away from the most consequential election of our lives. I know folks say that every two years, but this time it seems especially true.
Right now, we are full speed ahead in our effort to flip Congress, and we’ve already got Congress hearing from us. Our pressure campaign on the House and Senate has delivered more than 885,000 letters and made countless calls in less than two years. And if Democrats win back either or both chambers, we’ll be accelerating those efforts to make sure they follow through on what they’ve pledged.
Meanwhile, our social media Watchdog Coalition is pummeling the MAGA propaganda machine, spreading the truth every day to millions who would never otherwise see it.
This is all on top of our investigations and daily reports. We do it without any billionaire, boardroom, or advertisers—and that independence is what allows us to operate as both a reporting and an organizing hub. But that means we rely on our subscribers for funding. So if you haven’t yet, help power our movement through Election Day and beyond by becoming a paid subscriber today.
A Candidate And A Union Pulled Trump’s Ads
Trump spent millions of your tax dollars on TV commercials about how great he is. On Sunday I told you a Washington judge might stop them this week. A New York judge got there first.
On October 8, Robert Hunter—a Democrat running for the Alabama statehouse—and a local chapter of the building workers’ union SEIU asked that court to pull the ads before the weekend.
The regime’s lawyers argued it was too late. The ads were ending Sunday night anyway, they told the judge, so there was nothing left to stop. About $19 million of your money had already been spent, Politico reported.
Judge Jennifer Rochon said it wasn’t too late. She also said Hunter and the union will likely win their case that the spending broke the law. Her order kicked in at 6:45 Sunday evening. The night’s remaining ads had to be canceled, and nothing more gets paid on the contract. Until October 25, the regime can’t sign a new deal for these ads or renew the old one.
They didn’t all come down. Her order said off the air by 6:45. Two of the ads were still running after midnight, according to AdImpact data reviewed by the Washington Post. Whether that counts as ignoring a federal judge is now Judge Rochon’s call.
Trump had $19 million of your money and the whole federal government on his side. A guy running for the Alabama statehouse beat him anyway.
Judge Ali Unlocked The Trap
Trump Built
For many kinds of legal status in America, the government requires your fingerprints and photo. Miss that appointment, your application gets denied—and being locked up doesn’t count as an excuse.
Last December, the regime announced it would generally stop taking fingerprints from people ICE is holding. So ICE locks you up, the regime won’t take your fingerprints, and your application dies. That trap catches young people who were abused or abandoned as children, and survivors of human trafficking.
It caught Luis Felipe Estrada Trejo, who applied for a green card through his marriage to an American and ended up in ICE detention. Most of the people suing couldn’t be held or deported if they were approved, and some face threats to their lives back home.
The regime said the point was to stop “frivolous claims.” Federal Judge Amir Ali asked its lawyer how. The answer: “That’s a good question . . . . I don’t have an answer to that right now.”
Of course there wasn’t one. Trump doesn’t need a reason to be cruel.
On October 7, Ali froze the policy for everyone it impacts, putting the regime on the hook again for those fingerprints. Ali found it “effectively denies immigration relief to a whole category of people.” While the case continues, people who are detained with pending applications get a real shot at finishing them. The regime has to report back to Ali by October 21.
Trump tried to slam the door on trafficking survivors and young people abused as children. Judge Ali just pulled it back open.
Talarico Asks Paxton For Proof Of
Spine
James Talarico, the Democrat running for US Senate in Texas, came down with “a nasty case of the flu” in late September. He stayed off the trail until he got better, saying: “I didn’t want to get anyone else sick.”
His Republican opponent, Ken Paxton, turned it into a manhunt. Paxton’s campaign put out “MISSING” posters and demanded “proof of life.” Ted Cruz posted Talarico’s face on a milk carton. Trump wrote, “Where is he? What is wrong with him? Bad rumors are coming out.”
Then the right’s rumor mill went fully unhinged. Two influencers pushed a fake story about a secret hospital stay in Ohio, and Elon Musk—whose super PAC backs Paxton—helped spread it.
The hospital shut it down in one sentence: “Representative James Talarico has never received treatment from Lindner Center of Hope.” The influencers’ own phone recording claimed he was discharged Saturday evening. Saturday night he was at a Kacey Musgraves concert in Dallas. Talarico’s reply: “I’ve never even been to Ohio.”
Then Talarico flipped it on Paxton. “I’ve heard credible reports that Ken Paxton has a serious medical condition that causes clinical level of cowardice,” he told MS NOW. “He asked for proof of life from me. I’m asking proof of spine from him.” Trump demanded a debate too. Talarico agreed: “Ken Paxton should debate.” Talarico has accepted debate invitations from multiple outlets. Paxton hasn’t accepted one.
No Democrat has won statewide in Texas since 1994, but Talarico leads by six in the latest New York Times/Siena poll. Trump’s party can’t win the argument, so it invented a patient. It’s desperate, pathetic, and honestly—it’s quite lazy. And they failed, again.
Dr. Andrews Diagnoses Graham:
Unqualified
South Carolina Senator Darline Graham got her seat this summer, after her brother Lindsey died. Then Trump endorsed her and flew down to help her win the Republican primary.
On Sunday night, her Democratic opponent Dr. Annie Andrews, a pediatrician, said Graham had the chance to end Trump’s war with Iran, and “three times in a row she voted to continue it.” She’s right. Graham voted to block measures to end it on July 23, July 30, and September 24. In an August runoff debate, she’d admitted, “I’m not that informed on national security.”
So Andrews gave her diagnosis: “If your surgeon said that appendectomies aren’t really his thing, would you still hand him a scalpel? No.” Her verdict: “She is unserious and unqualified.” Later in the night, Graham insisted, “I’m just as qualified as you.” She said that to a doctor.
Then Andrews pressed her to agree to more debates. Graham said she’d rather “hear from voters.” And just before the debate ended, she said, “I’ve had a job representing the people of Wash—” before correcting herself to “South Carolina.” Andrews posted afterward: “At least she’s honest about one thing. I’ll be a Senator for South Carolina, NOT Washington.”
Two years ago, Trump won South Carolina by nearly 18 points. In late September, a Republican pollster had his handpicked senator ahead by one. Early voting starts October 19, and South Carolina can send a doctor instead.
There are only 21 days left until the midterm elections, and we are full speed ahead. There is nothing that will slow us down—we work like we’re behind, and we sprint through the finish.
The regime wants you to believe no one is fighting Trump. That’s never been true, and this week proved it again. The people taking him on don’t have private jets or TV networks—like a former teacher, union members, and a children’s doctor. They have the guts to stand up, and to keep showing up.
That’s exactly what we’ve done here for a decade now. Thanks to our independence no one can call me to kill a story. We don’t need to do any favors to get access to the White House. And if someone pushes back against our investigations, we dig in even harder—because we know we’re on the right track. That’s how we helped uncover the Trump-Russia scandal along with dozens of others over the years.
Paid subscribers fund all of this. They also will get my morning midterm briefings and a seat in our live war room on election night. Help keep us independent through November 3 and beyond by joining us today:
Then hit the ❤️ like button and restack. Three weeks out, every share puts the truth in front of someone still deciding whether to vote, before Trump’s spin gets there first. Thanks for all you do.
Onward!
Scott
If you could ask any Senate candidate one question, what would it be?
Trump spent $19 million of your money on ads about himself. What would you have spent it on in your town?

SOUTH CAROLINA: DARLINE GRAHAM is a BRAINLESS INSULT TO VOTERS!
Sent the first 3. I'm conflicted about the Flock cameras since WHEN THEY ARE USED PROPERLY, have assisted in solving crimes.
TRUE! But one of the issues is that they also capture images of BYSTANDERS - unrelated pedestrians. There were NO LIMITS on FLOCK CAMERAS.
Traffic cams have been used successfully on the CAPE COD BRIDGES and have identified drug traffickers and criminals.
But there have been no reports of MISUSE of those images, unlike FLOCK.
The filings are still open, the work is still getting done, and the YOU are still the reason any of it reaches anyone. And I’m so grateful. Onward.
I would spend that $19m in my community for affordable housing, healthcare for all and lowering fuel prices. So many rural Mainers will not be able to keep their homes warm this winter or keep food on their tables, yet our tax dollars go to a greedy old man who does not care about Americans.
Great answer Sheryl! I am very concerned for the people across the country who will not be able to afford to heat their homes either by oil, or the high cost of electricity that some are facing due to datacenters in their areas. Studies are also indicating a significant rise in the cost of construction of family homes due to DJT tariffs on lumber and other building supplies like copper wire.
Using those funds to stabilize heating costs for rural communities heading into winter is exactly what actual public service looks like, Sheryl. The contrast in priorities is glaring.
A women just got taken by ice in Florida who is breast feeding a 4 month old? Byron Donald’s congressional district and he is running for Florida Governor. So much for ice being cruel again. America last is the slogan. Not one of our ideals is in this administration and the cruelty towards people is their only goal!?!!
Deb, where is the AMA when this sort of thing happens. Don't they have a conscience? WE know nobody in this administration nor ICE has a conscience. My heart goes out to this woman and to her baby and family. ICE not so much.
The sheer lack of conscience required to execute those orders is staggering, Sandy. We have to vote out the enablers who allow it to happen.
Weaponizing an agency to separate a nursing mother from her infant is a level of cruelty that defies basic humanity, Deb. Florida voters need to remember that cruelty when they look at Byron Donalds' record!
I checked yesterday to make sure I'm a registered voter. And I am. Check yours, then VOTE BLUE!
Yes, my hubby & I are both registered and received our mail in ballots a few days ago. I'll be putting them in a drop box rather than trust USPO.
Let's work to expand MAIL IN BALLOTS NATIONWIDE!
It increases VOTER PARTICIPATION....it's VOTE IN YOUR PAJAMAS VOTING!
You can look up candidates and issues while sipping your morning coffee!
This year, the MASSACHUSETTS BALLOT was 4 PAGES due to 9 BALLOT QUESTIONS - DO IT AT HOME & DROP IT OFF SAFELY!
Utilizing those official drop boxes ensures your ballot bypasses the postal system entirely, Pam. Smart move!
Verify and vote! Perfect strategy, Lillian.
I would’ve spent that money splitting it between Medicaid recipients who were thrown off Medicaid and food for people in need.
We have to find a way to get universal healthcare. That alone will help people enormously in terms of financial well-being.
I had cancer 26 years ago. I had insurance but it cost me $40,000 over the insurance for the care I needed. At the time, I made a very good salary, and I was able to take care of myself. If it happened now, there is no way I would survive the way I did.
Your story is a powerful testament to why affordable, accessible healthcare is a fundamental necessity, Barbara. Redirecting $19 million from self-serving ads to stabilizing Medicaid would actually save lives. We have to keep fighting for universal coverage!
Thank you for sharing!
WE NEED UNIVERSAL HEALTH CARE!
Other nations that provide UNIVERSAL HEALTHCARE are not fighting ENDLESS WARS! Maybe it's time to slash the PENTAGON budget that never passes an audit.
Great come back and slap down Talarico!
Talarico's ability to dismantle bad-faith attacks with sharp, verified facts is why he is gaining so much traction, Ballard!
Impeach, Convict. Remove. R should be standing up and doing this.
Oh Random Human! Wouldn't that be a wonderful day! :-)
It would be a historic day for accountability, Sandy!
It is the only constitutional remedy left, RandomHuman.
If you ever have time Scott, I've seen this question before and I'm wondering too why MN. AG Ellison (I believe) hasn't charged Jonathan Ross or either of Alex Pretti's murderers? I would think they could bring state charges of murder? but I'm not an attorney so just wondering?
Colleen, I saw an interview of Minnesota's AG recently by Aaron Parnas and he addressed your question. He said they are still waiting on evidence that the feds are withholding and that it is very important that they have everything they need, to prove their case before filing it. The case will happen as soon as they are able to do that.
Thank you. Yes, as Pam says sadly that will never happen with this administration! So much for accountability!
Sadly, that doesn't surprise me.
That is a critical question about jurisdictional authority and evidence, Colleen. State charges require airtight cases, and federal obstruction can slow that down. I believe it's up to Moriarty
It's no consolation but there is NO STATUTE OF LIMITATIONS FOR MURDER.
tRump's LAWLESS ICE GESTAPO will continue to obstruct...there were initial reports that they failed to impound and protect the vehicle RENEE GOOD was driving...ICE GESTAPO failed to protect the CRIME SCENE where ALEX PRETTI was killed. ICE GESTAPO THUGS turned his body over to count BULLET HOLES and much else.
MASS GOP TRUMPERS blabbered 'WE SUPPORT LAW ENFORCEMENT!'
MAGA GOP BOOBS fail to speak out against tRump's LAWLESS ICE GESTAPO ABUSE!
This jeopardizes the safety of ALL OF US!
On Sunday my hubby, grandson and I dropped our ballots in a Santa Clara Country Registrar of Voters secure and safe dropbox. Waiting for BallotTrax to let us know our ballots have been received. We voted early and encourage everyone to do the same. We have three weeks to go and early voting is taking off like never seen before. Onward!
Dropping off ballots with your grandson sets a wonderful example of civic duty, Rebel! BallotTrax is a fantastic system. Thank you for voting early!
Loving it! South Carolina and Louisiana too? Yes, please!
South Carolina and Louisiana are absolutely in play if the turnout is high enough, Amy! SC much more likely by far though!
We adding two donations today for these states and one last round for our close races. Calls, cards, and reposts. Every little bit helps, just wish it could be more. Thanks for all!
I would really be happy if one of the judges found "DOJ" in contempt and actually Toady Blanche himself! I think the judge in the trees case is close. But Katie Phang's case could do it too. Judge Sullivan has done it before and told the DOJ lawyer (Block) that it's a promise not a threat!
Enforcing contempt orders with actual consequences—like Judge Sullivan has done—is the only way to reestablish the authority of the courts, Colleen. Katie Phang's case might just be the tipping point!
