House votes to strip judges' power to check Trump

 


The one branch of government that has stood in the way of Donald Trump's assault on the U.S. Constitution and rule of law is the federal courts.

Now Republicans are escalating their effort to sweep away even this one check on Trump's power.

Last month, Republicans passed the so-called No Rogue Rulings Act, which would strip federal district judges of the power to issue nationwide injunctions blocking Trump's illegal executive actions.1 In addition, the House is getting ready to take up the JUDGES Act, a bill that would allow Trump to pack the court with right-wing extremists by adding 66 new judges to the federal bench.2

This is an all-out attack on the federal judiciary in an effort to make Donald Trump king — and Demand Progress is mobilizing grassroots opposition to make sure these bills never become law.

As a candidate, Donald Trump said he would be a "dictator on day one" and called for the "termination of all rules, regulations, and articles, even those found in the Constitution."3

Too many mainstream media outlets didn't take those words seriously, and now we're learning that Trump meant every word.

He's shredding basic constitutional rights like freedom of speech, freedom of the press, and birthright citizenship. He's making a mockery of the rule of law by deporting permanent legal residents, student visa holders, and even U.S. citizens without due process. And he's illegally dismantling huge swaths of the federal government in open defiance of Congress's power of the purse.4

To date, the one meaningful check on Trump's power has been the federal courts. There were 46 challenges to Trump executive orders in the first 100 days, with many of them effectively delaying or even stopping elements of Trump's lawless agenda.5

But if the No Rogue Rulings Act and the JUDGES Act become law, the courts' power to stop Trump's authoritarian takeover will be severely weakened.
