Daphy Michel was 31 years old, a severely mentally ill Haitian immigrant who could not speak English.
ICE released her from Pittsburgh custody on February 27th and three days later she was found unresponsive at a bus shelter.
Last week the Allegheny County Medical Examiner ruled her death a homicide caused by hypothermia. |
DHS told reporters she was released on a sunny day with a fully charged phone but conveniently left out that the temperature in Pittsburgh dropped to 27 degrees two days later. If that account sounds familiar it is because this is the same department that told us they left Nurul Amin Shah Alam, the nearly blind Rohingya refugee we wrote about over the last few months, at a ‘warm safe location with no signs of distress’. His death was also ruled a homicide caused by hypothermia. At some point, the gap between what DHS says happened and what medical examiners determine actually killed people stops being a coincidence and starts being a pattern worth documenting very carefully. That is two post-release homicide rulings in the same month from two different cities and we only know about either of them because attorneys stayed on the cases and medical examiners did their jobs. And DHS just scrapped the policy requiring post-release death reporting. With rulings like these starting to land DHS decided the answer was to stop counting rather than stop causing them. The cases we do not know about are the ones where nobody filed a missing persons report and nobody stayed on the case. Michel's attorney said she was afraid to ask strangers for help. She had just been handed to federal agents and she had no reason to believe the people walking past her at that bus shelter would treat her any differently. DHS just made sure the next case like this one will never appear in any official count. Our team is going to keep looking for them anyway.
