Senate Republicans are about to blow up the rulebook that protects us from dirty air — and a whole lot more. They’re using the Congressional Review Act, which lets a simple majority in Congress roll back rules issued by federal agencies, to repeal Clean Air Act waivers which let states set stronger pollution standards for vehicles. Here's the problem: The Congressional Review Act isn't supposed to apply to these waivers at all. The Government Accountability Office has said so — twice. And the Senate's own nonpartisan referee, the Parliamentarian, reaffirmed last spring that Clean Air Act waivers aren't "rules" subject to the Congressional Review Act. But Republican leadership in the Senate is trying to ignore the rules and repeal these waivers anyway. This attempted repeal matters far beyond clean air: Overruling the Senate Parliamentarian here means opening the door to overruling them whenever it's convenient. If senators ignore the Parliamentarian's rulings and the plain text of the law this time, nothing is off limits: Anything agencies do could be repealed with a simple majority vote, and Congress could stuff big budget reconciliation bills (like Trump’s Big Ugly Law) with even more harmful provisions that shouldn’t be allowed under Senate rules. But this fight isn't over. The Senate needs to hear, loud and clear, that voters are watching to see if they’ll ignore the Parliamentarian for a short-term political win.
