The Regime Argued No Court Could Stop It

Last Tuesday, we reported on a judge who froze the regime’s demand for 17 million drivers’ Social Security numbers. Nobody reported what the DOJ actually filed. We did. There’s so much more to the story now.
The DOJ’s first argument was that no court in America even had the authority to hear the case. No matter what courthouse the states who were suing over the data chose, the DOJ said it was the wrong one.
The DOJ’s second argument was worse. They claimed that privacy law only protects citizens and green-card holders—so anyone else’s records are theirs to hand over.
Then the DOJ’s own witness sank their case. The agency’s safety chief admitted under oath they already can look up any driver in that database, one at a time, whenever they want.
So why demand all 17 million files? Because right now they can only look up one person at a time, which means identifying that specific driver. If given a master file, they can search however they want—without having to name anyone.
On Thursday morning, Judge Anthony Trenga asked the most obvious question: What do you need these for? The DOJ didn’t have an answer. Later that day Trenga ruled that the states will likely win on every count, the files will stay put, and the regime can’t touch anyone’s funding for refusing to hand over the data.

Letitia James Beat The Prosecutor They Installed

Trump has sought payback against New York Attorney General Letitia James for years. Two particular cases bothered him the most, including the fraud case James won against his company, and the case she won against Trump’s ally the National Rifle Association.
In August 2025, federal prosecutor John Sarcone III subpoenaed every file that James had on both cases. What was truly strange is the fact Sarcone demanded everything be sent directly to him. That’s not how cases like these usually work.
But Sarcone’s temporary appointment had already run out—and the federal judges in Albany had refused to extend it. He wasn’t supposed to be serving in that role anymore. So the DOJ moved another lawyer out of the chair and slid Sarcone in.
In January, Judge Lorna Schofield killed the subpoenas. Then the DOJ asked her to let Sarcone keep working while they appealed—so she looked at what he’d bring to the job and said no. Sarcone had never prosecuted a case in his life—not one. Seriously.
On Friday, the appeals court agreed. James never handed over a single document. Trump used the DOJ to come after her and lost anyway.
The Companies That Said No Lost Nothing

Last January, Trump signed an order threatening any company that kept its diversity programs—or DEI—in place.
Some companies like Target and Walmart gave in immediately. T-Mobile seemed to fold because they were waiting on a merger to be approved.
But wholesale giant Costco didn’t budge. Two days after Trump signed the order, Costco’s shareholders voted on a conservative group’s proposal to walk away from DEI. They killed it, 281 million shares to 4.8 million. Apple and John Deere investors rejected the same kind of proposal weeks later, both by around 98%.
Researchers at Stanford and Berkeley studied America’s 500 biggest companies, and what they found was that none of them faced severe consequences for keeping DEI. They kept pretty much the same stock prices, and sales essentially stayed the same.
Costco said no and lost nothing. It was a bluff. Target and Walmart just never called it.
The RNC’s War On Your Mailbox Collapsed

In Nevada, mail ballots are valid if they’re received within four days of the election—as long as the postmark proves it was sent on time. Republicans had a problem with that, so in 2024 they sued to put an end to the grace period.
The case was thrown out by Judge Miranda Du, who said no one had been hurt by the rule. The judge added that Republicans couldn’t sue over an injury that never happened. So of course Republicans appealed that ruling.
On Friday—around two years later—the appeals court agreed with Judge Du. That’s five states now where these same lawsuits have died.
If you vote by mail, it will count. November is coming.

Alaska Republicans Split Their Vote

The read I’d give a candidate at a kitchen table with 71 days to go.
Peltola finished ahead of Sullivan. Dem nominee for Senate Mary Peltola got 48.1% to GOP Sen. Dan Sullivan’s 42.7% in last week’s open primary. Sullivan’s held on to the seat since 2015. Cook Political Report rates the race a toss-up.
Murkowski endorsed Sullivan. Alaska’s other senator Lisa Murkowski endorsed Peltola in 2022 and in 2024. This year, Murkowski endorsed Sullivan.
The other Dan Sullivan. Daniel J. Sullivan Jr.—not the Senator—is a retired schoolteacher who got 2.4% of the vote. He was a registered independent until last year, and he will be on the ballot in November. In a race this tight, it could be the difference.
Democrats take the top. Two Democrats took the top spots in the gubernatorial race, with Jonathan Kreiss-Tomkins at 21.6%, and Tom Begich at 20.1%.
A fractured party. There were 12 Republicans on the ballot for governor. The two Democrats at the top pulled a combined 41.7%, while the Republican vote was spread thin. It’s clearly a party in chaos.
The House incumbent underperformed. Nick Begich III, who took Peltola’s House seat in 2024, got 46.1%, while independent Bill Hill got 30.9%.
The Bottom Line: Alaska Republicans went into Tuesday holding everything and came out with both incumbents under 47%. That’s not a bad night. That’s a trend. Alaska is in play.
Judges have carried an enormous amount of weight holding the line across the US, especially with the unhinged dictator in the Oval Office. But a court can only do so much to protect our country. The rest relies on us.
After 23 years in this business—10 of them fighting Trump—I can tell you the way to beat them hasn’t changed. If we show up in record numbers to vote, we win.

Would be nice if people in Florida stepped up to vote, but typically not the case. Remember, democrats need five states to flip because Pennsylvania with Fetterman is now on the path to changing parties.
Every time I hear about a department of justice lackey failing, flailing in a courtroom with a judge that asks valid questions, I always come back to what the judge should say to this fake lawyer. Where did this lawyer get their license? And, when I refer you to the bar for an ethics investigation for the case in front of the court, how does that look on the lawyer's resume when the DOJ starts its purge in 2029?

The New York City Bar Association took the extreme step of writing a letter to the Chairman and Ranking Member of the U.S. Senate Judiciary Committee, urging the Senate to reject his nomination. “Mr. Blanche has taken actions that we believe make him unfit to lead an ethical and independent department of justice that is essential to our nation’s democracy,” the City Bar writes. “Mr. Blanche’s record—particularly the actions he has undertaken as Deputy Attorney General and Acting Attorney General—conclusively demonstrates his lack of commitment to the integrity, professionalism and independence that the Senate should require and the American people should expect of the highest law enforcement official in the land.”

I'm still very concerned about voting by mail across the country. Not an option where I live, but the current head of post office has made it clear he is willing to do whatever Donald wants. What's to stop them from simply trashing all the mailed vote that come through, or worse yet, opening them to check who the votes are going to before sending only the "right" ones on?
Drop boxes are usually outside Board of Election buildings. So staff take the ballots inside each night. The (one) drop box in my county has a 24hr surveillance camera filming the activity.
Use available drop boxes for mail-in ballots.
Who transports the ballots?
That's a federal offense no matter who does it. Would they want to go to prison for Trump? There's no guarantee he'll pardon them if they're caught and they'll still have legal fees to pay.
One can only assume that some of his cult members don't think any further ahead about consequences than he does. Who knows? Holding tension until January (and beyond?) is not doing me any good.

Thank you for kinds words. I try, but it's hard. I'm blessed/cursed with a high level of empathy, and I simply *feel* all of this more than many folks do, sometimes physically.
Harris, please know I too am in the full of empathy/sympathy mode of being. I have that strange capacity to jump into action when needed and later find myself a bundle of fear and anxiety. To some extent sharing thoughts here on Scott's Substack and a few others seems to help. I think it lets me know that there are still many fine people in our country! And around the world! :-) One of the people I have come to rely on for settling my nerves here on Substack is a British yoga instructor who puts out weekly little things to do that help! She is always a good email to find, with both free and paid subscriptions. No need to do anything but listen for a few minutes and feel better.
