Dereliction of Duty: New York Times, Washington Post and Wall Street Journal editors continue to trivialize assaults on the First Amendment

The editorial leadership of the New York Times, the Washington Post and the Wall Street Journal downplay and deprioritize coverage of worsening attacks on press freedom. This is a dereliction of duty.

Minimal coverage of the indictments of journalists Don Lemon and Georgia Fort expose the habitual democracy-washing of the escalating attacks on the First Amendment. The same influential media institutions that fail to accurately communicate the constitutional crisis or to stand up for American democracy in its existential battle against the fascist MAGA movement are also insufficiently covering the accelerating attacks on the First Amendment. It is not partisan for editors to prominently feature attacks on press freedom. To the contrary, it is a duty.

Key Takeaways

  • New York Times, Washington Post and Wall Street Journal leadership minimized coverage of Don Lemon and Georgia Fort indictment and arrests.

  • All three outlets had one sentence each on their influential front pages.

  • Online coverage was fleeting.

  • Within one day there was no further coverage of the Department of Justice acting at the orders of the President of the United States.

  • Good news: Editors of the Los Angeles Times and two local small papers did put the arrest on their front pages.

Timeline:

Thursday January 29, 2026 journalists Don Lemon, Georgia Fort and others were indicted and arrested for being present at — and documenting as journalists — a peaceful protest at a church whose pastor was discovered to be a local ICE field director. Peaceful protest is protected by our First Amendment, as is Lemon’s and Fort’s right to report on events. These charges have been widely seen as a blatant attack on the First Amendment and the consequence of a MAGA- and weaponized U.S. Department of Justice.

The alarming fourteen-page complaint against Don Lemon, fellow journalist Georgia Fort (who is also vice president of the Minnesota National Association of Black Journalists NABJ chapter), and seven activists and civic rights lawyers, is remarkable for its fundamental affront to the First Amendment.

Friday January 30th, there was substantial online outrage from press, attorneys, historians, and news organizations. We joined other allies in signing on to and uplifting the statement by the National Association of Black Journalists (NABJ) denouncing the indictment, demanding those arrested be released and all charges be dropped. You can read our post on the statement.

Saturday January 31st, the influential front pages of the New York Times, Washington Post and Wall Street Journal each had a single line directing readers elsewhere.

All three legacy media leaders failed to frame this as a First Amendment case instead taking a “view from nowhere” frame and making it a “protest” related case.

A.G. Sulzberger’s New York Times, Grade: D-. One sentence on A1. Text on A14.

Jeff Bezos’s Washington Post, Grade: D-. One sentence on A1. Text on A3.

Rupert Murdoch’s Wall Street Journal, Grade: D-. Misstated case “immigration enforcement protest” - no, it’s that the pastor is an ICE field director! Text on A3.

NYTimes headlines evolve with time. Neither captured the First Amendment nature. Notable that there's mention the case was rejected before. Indicates knowledge of prior court findings of insufficient grounds; could have been in the headline. “Charges rejected in past hearing…”.
Washington Post editors initially framed it as Don Lemon arrested “over” church protest which is not the reality. “in connection” still fails to frame as First Amendment.
WSJ at least mentioned that Lemon “said he was covering” as a member of the media - in other words as a journalist with First Amendment rights.

Good News. Editors of three news outlets put the arrest of Don Lemon and others on their Front Pages. Patrick Soon-Shiong’s Los Angeles Times, St. Cloud Times (MN) and The Day (CT)

Credit to the editors of these organizations for recognizing and prioritizing this story for their readers. These editors at least have not accepted the MAGA-Department of Justice propaganda that Lemon and Fort and others violated Federal civil laws.

“Journalists at state church protest arrested” is a strong headline. Factual. Objective.

It is a story unto itself of the weaponization of the Department of Justice against Americans and journalists - and that the White House is perversely reveling in it.

Observations and Conclusions

It is stunning that the editors and publishers of the most influential news organizations in the country do not see abuse of power of the Federal Government against citizens exerting their First Amendment rights as a front page or multi-day story. Though these outlets did offer some coverage subsequent days, none of it was prioritized to be on the front or landing pages of their publications.

We provide additional context to this report in our post “The First Amendment is under siege. Journalists are being indicted and arrested”.

It seems that legacy media editors’ and publishers’ motto is “First Amendment rights for me - but not for thee” when it comes to citizens and journalists not in their organizations.

In the context of accelerating fascism and attacks on press freedom it would be wise for the leaders of journalists and especially those in prestigious and influential newsrooms to adopt the motto “All for one and one for all” (h/t Alexander Dumas).

We will continue to follow the coverage of this and other First Amendment cases.

And urge you to support and give your attention to news organizations and journalists that DO advocate for the First Amendment rights for all Americans.

Your pro-democracy action in support of a better-informed America

Ask the media oligarch who runs the New York Times why his “paper of record” is apathetic towards the rise of fascism, does not consider First Amendment attacks worthy of consistent front page coverage, and all while minimizing the pro-democracy movement:

Send a letter to A.G. Sulzberger - ask him if he has a red line that could lead him to switch gears at the NYTimes to meaningfully cover and prioritize attacks on the First Amendment?

MAD Hero of the Month: Will Bunch

Will Bunch of the Philadelphia Inquirer is not afraid to call out the Trump regime’s fascism. Bunch exemplifies the power of opinion journalism to tell the truth and defend democratic principles.

American democracy and journalism need more heroes. Our Media and Democracy Project hero for October is Will Bunch of The Philadelphia Inquirer. Included in this post are actions to take to thank and support Mr. Bunch.

“Words still not only matter, but have incredible power. What we are witnessing is American fascism. I am an anti-fascist.” — Will Bunch

Words are powerful tools. As George Orwell portrayed in his post-World War II book 1984, the deliberate misuse of language (Orwell’s so-called “Doublespeak”) by a fascist regime is a manipulative and deceptive form of propaganda intended to a control society and alter its perception of reality. The current resistance of most legacy news outlets in the United States to accurately describe the destructive and corrupt activities of the Trump regime threatens to distort our understanding of what is happening around us. This distortion can prevent media consumers from perceiving and reacting to even the most obvious infringements of our constitutional rights. Even worse, it encourages the acceptance or avoidance of outrages such as the invasion of our cities and the abuse of our people by a violent, masked secret police force.

At least one columnist and his publisher have chosen not to abdicate their role as the independent Fourth Estate of our democracy and have rejected the use of weak euphemisms to describe the ongoing horrors of the Trump regime. On October 5, 2025, The Philadelphia Inquirer published opinion columnist Will Bunch’s column “Why we can’t allow Trump to ban that other f-word:The column the Trump regime wants to ban: America has to call out surging fascism in order to defeat it.” Bunch muses on the possibility that Trump would very much like to ban his column, citing the “National Security Presidential Memorandum NSPM-7”, in which the Trump regime designates “Antifa” as a “Domestic Terrorist Organization”. That “Antifa” is not an actual organization has not deterred the regime from defining it as such and issuing an assembly of ridiculous and fascist directives targeting anyone who is not MAGA or who dares to disagree with the Trump regime’s policies.

As Bunch points out, the term “Antifa” is short for “Anti-fascism”, which is simply an ideology that opposes fascism. Bunch writes: “Trump, in his memo, attempts to rebrand anti-fascism, writing that ‘these movements portray foundational American principles (e.g., support for law enforcement and border control) as ‘fascist’ to justify and encourage acts of violent revolution.’”

Bunch cites historians such as Timothy Snyder and Robert Paxson to help define American fascism. He goes on to emphasize that in the regime’s efforts to destroy American democracy, Trump is ignoring our constitutional right of free speech and attempting to cover up the outrageous, aggressive, and potentially illegal activities of the U.S. Immigration and Customs Enforcement (ICE) and Customs and Border Patrol (CBP) in our cities: “This isn’t some arcane dispute over language. The Trump regime is desperate to control the words of America’s political conversation because they want to normalize what they are doing right now, which is pursuing a rapid race to demolish democratic norms and institutions.”

“The reason is simple: Defeating fascism requires a very different type of posture — both politically and morally — than might an old-fashioned political quarrel between liberals and conservatives over tax rates and government services. To truly oppose a fascist Trump regime, we must declare ourselves anti-fascists.”

Bunch’s clear analysis of the nature of speech and our right to use it is a sorely needed acknowledgement from a major city newspaper that we are indeed witnessing the unfolding of a fascist police state on American soil. Bunch’s bravery to speak the truth and to name it FASCISM, along with the Philadelphia Inquirer editor’s willingness to publish his column, is a beacon to all of us who oppose and want to speak out against Trump’s corrupt regime.

Today, democracy and all the principles and rights that accompany it are under siege by the Trump regime. We desperately need the press and media to stand up for our rights and unabashedly speak the truth.

Thank you, Will Bunch. The country owes you a debt of gratitude for your bravery and perseverance, and your powerful use of opinion journalism to tell the truth and defend democratic principles.

Signed,

The Media and Democracy Project community.

UPDATE: Since awarding Mr. Bunch our “Hero of the Month” in October the Trump administration has further weaponized the power of the federal government using the infamous presidential memorandum (NSPM-7). Here is journalist Ken Klippenstein who first obtained the memo discussing its danger and recent use by US Attorney General Pam Bondi.
