Attorneys Brian Kabateck and Shant Karnikian dig into HHS Secretary Robert F. Kennedy Jr.'s quietly reversed ethics commitment over his Gardasil vaccine lawsuit fees, now the subject of a formal Senate inquiry. Kennedy, a longtime vaccine skeptic, originally held a 10% referral-fee stake in roughly 200 Gardasil cases filed by his former firm, Wisner Baum, alleging Merck's HPV vaccine caused cervical cancer — claims a judge rejected on summary judgment for lack of scientific evidence before Merck settled anyway for $50 million in June 2026. Under pressure from Senator Elizabeth Warren during his 2025 confirmation, Kennedy signed an ethics agreement promising to irrevocably assign his Gardasil stake to his adult son Conor, a licensed California attorney at Wisner Baum — but just ten days later, on February 11, 2025, he quietly reassigned the interest back to the firm itself, two days before the Senate confirmed him without knowing about the change. Brian and Shant explain that under the U.S. Office of Government Ethics' own guide to nominee agreements, a sworn ethics commitment can't be rescinded without OGE approval, since the Senate relies on those commitments when voting to confirm. Kennedy didn't publicly disclose the switch until August 1, 2026, posting on X that he'd "relinquished any interest in potential Gardasil fees back to the Wisner Baum law firm" — only after lawmakers' questions forced the issue, and HHS later confirmed the reassignment in writing. Brian and Shant flag the obvious conflict: Kennedy, as HHS Secretary, now directly regulates Merck, the very company that just settled the case tied to his former fee stake. Brian's bottom line: nobody has proven Kennedy personally profited, but the unexplained non-disclosure, the timing two days before confirmation, and the regulatory conflict raise exactly the kind of questions a sitting cabinet secretary should have to answer.
