Some Republicans, like Sen. Barrasso (WY) and Sen. Capito (WV), want to misuse a tool called the Congressional Review Act (CRA) to overturn the ability for states to set stronger vehicle emissions standards than the federal government’s. Twelve states and the District of Columbia have received waivers through the Clean Air Act that allow stronger standards than those written by the federal government (with more states likely to adopt the standards if the waivers aren’t overturned). Both the Government Accountability Office and the Senate Parliamentarian — neutral observers with no stake in clean vehicles — have ruled that the Senate does not have the authority to use the CRA to repeal the Clean Air Act waivers. But Senate Republicans are ignoring them and intend to move for a vote to roll back the standards next week. Misusing the CRA in this way weakens state authority, threatening not just vehicle emission standards but any state-specific protections that follow a similar waiver process. So even if you’re not in one of the twelve states (CA, MA, NY, OR, CO, DE, NM, VT, WA, MD, NJ, RI) or DC whose standards could be ripped away, this vote still matters for you. The House already voted to repeal the Clean Air Act waivers, so the Senate is our last chance to stop severe health, economic, and environmental consequences including:
