New SCOTUS cases could upend elections
Republicans asked the U.S. Supreme Court to review cases out of Illinois and Montana that could upend election administration in the United States. In a new YouTube video, Marc and Democracy Docket’s Paige Moskowitz discuss the impact of these cases.
In November, Illinois Republican Rep. Michael Bost asked the Supreme Court to revive his twice-dismissed legal challenge to state law that allows election officials to count timely postmarked or certified mail-in ballots for up to two weeks after an election.
In August, Montana Secretary of State Christi Jacobsen (R) asked the nation’s highest court to consider the radical independent state legislature theory as reasoning to uphold two Montana voter suppression laws. The theory promotes the idea that only state legislatures have the power to regulate federal elections.
November had the most voting rights lawsuits filed in 2024
November saw the most voting rights lawsuits filed in 2024 so far. In fact, the 61 cases brought in November make up almost a quarter of the total cases filed this year. This includes litigation filed before, during and after the Nov. 5 election.
September was the next highest month with 44 cases filed.

Court hearing coming up tomorrow
A hearing will be held in a Republican lawsuit challenging Arizona’s voter rolls. The plaintiffs claim that the state is not properly maintaining its voter records and at least 500,000 voters should be purged.
