Logan Act: Why Elon’s calls to Putin, Netanyahu, and more may be illegal — and what you can do about it

Troubling reports confirm that Elon Musk has had regular contact with Russian President Vladimir Putin for the past two years.[1]

Putin himself told Tucker Carlson earlier this year “I think there's no stopping Elon Musk. He will do as he sees fit. Nevertheless, you need to find some common ground with him. Search for ways to persuade him.”[2]  it’s time we found out exactly what sort of ‘persuasion’ we’re talking about.

The Logan Act prohibits U.S. citizens from negotiating with foreign governments in dispute with the United States without prior approval. It’s rarely been used, but it’s time the Department of Justice dust it off to investigate Elon Musk now.

Musk’s actions are not only potentially illegal, but there are growing concerns he’s using his enormous political and social power to jeopardize prospects for justice in Ukraine, Gaza, and beyond. We deserve to know: Is Elon Musk breaking the law?

Robert Reich has called it, “a concerning level of power over U.S. national security.”[3]

Here’s just a snapshot of what Musk's power looks like in action: He has recently used Starlink to disrupt Ukraine's military communications, bragged about his “top-secret’ security clearance” on the campaign trail for Donald Trump, and allowed Russian disinfo campaigns to run rampant on Twitter.

In April 2023, Musk tweeted, “Between, Tesla, Starlink & Twitter, I may have more real-time global economic data in one head than anyone ever.” That's a particularly alarming assertion from someone whose company, SpaceX, is also being paid $1.8 BILLION to build a network of hundreds of U.S. spy satellites — and is regularly chatting with an authoritarian like Vladimir Putin.

Luckily, the Logan Act can prevent unauthorized individuals from meddling in sensitive foreign affairs and undermining official U.S. policy.

From private “businessmen” like notorious Blackwater founder Erik Prince to public officials like the former President, Win Without War has never shied away from shining a light to expose corrupt and unethical behavior. Frank, we were unequivocal that now-former Senator Menendez should be investigated and resign after allegations arose that he accepted bribes from the Egyptian government last year. We similarly demand a full and thorough investigation by the DOJ into Elon Musk’s contacts with Putin.

And we’re not alone. Even the head of NASA, Administrator Bill Nelson, agrees: “If the story is true that there have been multiple conversations between Elon Musk and the president of Russia then I think that would be concerning, particularly for NASA, for the Department of Defense, for some of the intelligence agencies.”[2]

By demanding this investigation, we can remind decision-makers in DC that no one – not billionaire tech moguls, former presidents, or powerful senators — is above the law. Protecting the integrity of our democracy by ensuring political and business leaders are held accountable looks like speaking up today.

The DOJ must launch an immediate and thorough investigation into Musk's communications with Russian Pres. Putin to determine whether he has violated the Logan Act. Sign now if you agree.
